Hi All
New to this forum and looking for a bit of advice i am trying to cut down on my monthy out goings as things are getting tight again.

Over 10 yrs ago i had a major financial problem and went through a company called Eurodebt which had me paying reduced amounts ,one of my loans was with HFC Bank for around £5000 ,i was offered a settlement figure from HFC of around £2500 but couldn't afford it.
Several months later they sold the debt to TBI Financial services who sent me a letter informing me they had bought the debt from HFC and i owed them nearly £5000 which i had to pay at a set amount each month i told them to contact Euro debt as they were dealing with my finances.
It was agreed that i would pay a reduced figure but i kept getting phone calls checking my financial standing,i applied for a couple of credit cards and got a Capital one card with a limit of £400 ,i then got a phone call from TBI as they had checked my Credit record and asked me why i had been applying for Credit cards and informed me that i was in breach of the provisions on the agreement and had to pay the balance of £4,946.90 by the 13th of May 2005.
The letter i recieved stated that i had failed to make the payments and i will be taken to court,so in a panic i phone them and made arrangements to pay £81.61p for the next 5 years ( still paying it now 20 months to go ).
It is only now that i decided they were wrong as i didn't default on any payments and it's time to see if i can do anything about this.
HFC had offered my a settlement figure of £2500 would they had sold this to TBI for the full £5000 and if not can TBI make me pay the full amount ?

Eurodebt haven't contacted me for several years since they tried to tell me that my contract with them had ended and i need to renew it which involved a monthly payment ,so i pointed out that my contract never had an expiry date as i was one of their first customers (before they worked out they would get more money charging monthly 1 off payment £200 )so i can't go back to them (don't want to anyway)
Any help or advice of my next move will be apreciated

Hello and welcome. I am on a steep learning curve and getting help from people who have survived! One thing I have learnt is that your alleged debt will have been sold for a fraction of th amount that thy are claiming. The advice I was given was to send off a letter for a CCA or Comsumer Credit Agreement I think it is N from the templates library to prove that the debt can be legally enforced, you need to send a postal order, do not sign the letter and send recorded delivery. Also, do not speak to them on the phone and record all attempts to contact you. I'm sure someone with more knowledge and experience will help you either tonight or in the morning. Good luck

cymru is right ... they would of bought the debt at a fraction of the true value send them letter N from here with a £1 P/O print/ type or use a digital signature DONOT sign it.

Hi All
Ive had the CCA back from TBI ,well its the Personal loan agreement /Credit agreement which i assume is the same.
Its a clear copy which states,
Amount Borrowed £7000,add £3657.80,total sum Payable £10657.80. 60 monthly instalments £177.63.
Protection ins
£576.78,Cash price £576.78 Add £301.03 total sum payable £877.80
60 Monthly instalments £14.63.
So i assume thats it then i will have to carry on paying TBI until the debt is settled,is there no way of finding out how much TBI paid for the debt ?
The fax was also faxed to TBI from HFC as it has their stamp on it so do they buy the debt from HFC or collect it for HFC ,If i wanted a settlement figure would i be better of asking HFC or will i have to go through TBI.
I still have 21 payments of £81.61 to make (£1713.81) and have paid over the last 39 months £3182.79 which i think is more that they bought the debt for.

Hello, could you scan the agreement on to this site after hiding your details, then one of the many experts could advise you if the agreement contains all the proscribed terms.
Is it worth sending an S.A.R. with a £10 p/order to see if there have been charges which you can reclaim
