| Who are Incasso.co.uk Who are Incasso.co.uk??????? Are they new DCA’s on the block I’ve never heard of them before? I’m in a CCCS DMP and although it has lapsed (I am 3 months over due for a review), I still make payments through them. I received this letter from the DCA above stating that they have commenced legal action against myself for the full debt. WHAT!!!!!!!!! I really don’t understand this I’ve been in the DMP for 2 years NEVER once missed a payment and they threaten legal action for the full amount completely out of the blue? The original debt was with cooperative bank so has this been sold to them because I notice no fee has been added to the debt, are they doing it out of the goodness of there hearts. What gives here??? Who are Incasso? One quick look at the website tells me they are a specialist Debt Recovery division of Cobbetts LLP Solicitors. Being a DCA within a solicitors practice worries me somewhat. This for me has taken an ugly turn, DCA’s are lawless scumbags who pretend to have legal authority but these guys it would appear to actually do. Does this mean they are serious, why would they pull a stunt like this when I have never missed a payment? What can I do? Can I CCA them this was a Co-operative bank account debt with an OVERDRAFT. CAN I CCA A BANK ACOUNT??????? In which case who do I CCA incasso or cooperative. If they want to play rough and intimidate me I’d like to know I can fight back with something. Please help thanks in advance

| Re: Who are Incasso.co.uk You can CCA a bank, but they do not need to comply fully with the CCA 1974 (only bits).
Best bet is to send a Subject Access Request and see if there are any recoverable charges. |

| Re: Who are Incasso.co.uk Incasso keep poking their nose into my dispute with the co-op.
My understanding is that “Overdrafts” are covered by the Consumer Credit Act in 1989 a determination was made under Section 74 including “Overdrafts” in the Consumer Credit Act. So you can try a CCA request. As Tigs has said have you considered claiming for the charges on the account, if not get that S.A.R. in straight away. |

| Re: Who are Incasso.co.uk Sorry to resurrect this post but I’m still pretty concerned.
After almost two years of payments and not one single missed month I am now facing a demand for the full balance of the debt and threats of legal action.
I’m coming out of the CCCS DMP cos I’ve got strong cases against two creditors using CCA’s and not sure that CCCS will be supportive to my actions. In fact being bank backed I’m certain they won’t.
So I’m going it alone and need to know how to deal with this new threat.
Incasso.
This is not fair what have I done wrong, everything was fine, I paid cooperative bank, they occasional sent letters demanding more money, I rang them said one word ‘ CCCS’ and that was the end of it, things were fine. Now suddenly our friendships has been ruined by incasso who want full payment.
Who is this scum masquerading as solicitors and why has it been passed to them from the cooperative bank?
What can I do I don’t have the full balance I can’t pay more than I have been doing that is the whole point of being in a DMP D'oh!!!
Anyone got any options????
Ones that involve threatening letters would be more welcome than advice. |
