Default Lowells smell new blood!!

Had a letter a few weeks back from Lowells asking to confirm "info that you lived here". Found this site after keying Lowells into Google to see who they were and found out lots of useful info about them and what to do about them. Initially I sent them the Stat Barred letter as I moved 5 1/2 years ago and have no knowledge of the debt £8.5k !!!!!!! My ex-wife and I divorced 3 years back so maybe her but not sure.

Anyway, I had a reply like SC did saying "they would look into things and exchange info and this could take time etc etc" so as with Clownell Fan Clubs advice to SC I sent them an S10.

Now I have a letter stating this:- "From the point of purchase of the debt from Lloyds, Lowell has become the data controller as defined in the Data Act in place of Lloyds". They go on to say basically they can process my personal data as they seem fit as they are now the legal owner of the debt.

Then more worryingly, it goes on " we would further advise the Limitation Act 1980 Section 5 is not applicable in your case and as such statements and the agreement from Lloyds has been requested and will be forwarded on when we receive them. We can confirm all collection activity will cease and the account will be held in abeyance until the documentation is forwarded to you".

Someone please help and advise what I should do now if anything at all. If I just sit back though, what is it they are conjuring up for me?

just sit back and wait-it's up to them to provide what you asked for.....if the debt is older than 6 years,then it's curtains for them,no matter what they would like to think.....the law is the law!!

Thanks for that. Never actually asked them for anything though but looks like I may get it! Trouble with the 6 years is although I have no knowledge of this, certainly for 5 1/2 years, my darling ex may well have been paying some loan before we split and the house sold

well if the debt is in her name you have nothing to worry about, if it is joint then make sure they have both signatures on the agreement, either way wait for clownell to produce something.

If the debt exists, then it would have been in joint names as we both always signed everything! What does that matter to clownell's though, can they just hassel me as no one knows where she is?
Should I wait for them indefinately or go on the offensive and request the cca and statements thereby giving the s**ts 12 days + 30 time restraint?

We did have some debt, but I just don't remember this one. I thought that all the debt was cleared by the divorce court when our house was sold and the balance divided. But it seems that maybe not....... Lowells did say in the last letter that they will supply copies of statements and the agreement sometime in the future, so they sound pretty confident and sure they have me!! Part of their mindgames perhaps??

Oh no. Why would any of these companies do something like actually check that they have correct figures, papers, people, addresses? That would involve spending money on training your staff about the law, and then actually following it. Far easier to do what you want, rely on consumer ignorance, put the willies up people and let the profits roll in unabated. Nice work if you can get it!

You do have a point though! At this stage, I have accepted no debt from them, (letters headed "I do not accept etc")(and not signed) and I do not know myself yet if it is even mine, and probably at this stage neither do they which is why their last letter was so polite. Let's see what the parasites turn up with.....

Lowell always claim to have purchased the alleged debt yet when asked to produce a CCA they always have to 'refer to their client'. Of course they are supremely confident that their client will have the properly executed CCA and that you will have no option but pay in full when their client forwards them the CCA. After a couple of weeks their confidence wanes somewhat when they offer you a 60% discount if you pay prior to their client supplying you with the proper documentation. A week later they are even less confident of getting the documentation and give you a final chance to avail of their generous offer before admitting defeat a week or so later by closing their files.

Seems they tell so many porkies that they confuse even their own tiny minds.
