| Subject access request ????? hi
can anyone out there please enlighten me to what exactly a subject access request is and what is its purpose
i sent an s10 notification to lowell and they replied like i`d sent them an s.a.r
is an s10 a request for an s.a.r ? reading it i cant see how but it is in legal speak so maybe i`m missing something
im about to send the s10 again pointing out i didn`t request an s.a.r and need to know if this is the right approach
surely if they send me all their information on the account without actually finding out if i am that person there is breaking of data protection issue`s

| Re: Subject access request ????? Hi schrodingers cat  . The s10 letter you sent to Lowells, I believe that is the prove it letter. You havn't at this stage applied for a CCA. If it is the prove it letter then let them get on and prove it if they can. At this stage I would do nothing. Just wait and see what they come back with. STATUTORY NOTICE UNDER S10 DATA PROTECTION ACT 1998 At NO time have I given my written permission for you or your company to process my data Therefore Take Notice that I require that you cease from processing within 7 days of the receipt by you of this notice or else that you do not begin to process any personal data of which I am the subject insofar as that processing involves the communication or passing of personal data of which I am the subject to any third party and insofar as the said data relates wholly or in part to the implementation by you of charges which have been applied to my account in respect of defaults or contractual breaches and where the said charges which have been levied at a rate which is in excess of the administrative costs incurred by you as a consequence of the said defaults or breaches contrary to The Common Law.
This Notice is given on the grounds that the processing or continued processing by you of the said data will be likely to affect my credit rating and my reputation and cause substantial damage and/or substantial distress to me and my family members in addition to that which may already have been caused and that as the processing of the said data in the way referred to in this notice would violate the first, fourth and sixth principles of The Data Protection Act 1998 to do so would be unwarranted. Failure to remove ALL my data from your databases will result in a formal complaint to the Information Commissioners’ Office.

As zazen.warrior points out.
A section 10 letter is to tell them to stop processing your data as they do not have your consent to do so. I hope this is now clear and I apologise for any confusion.  |

i`ll give you a brief synopsis
i got an are you this person letter off lowell,i ignored it then i got a you owe us this much for a cap 1 debt,i sent a prove it.then i got a. we are looking into it letter,i sent an s10.then i got a re your subject access request letter we are sending your data.so i replied with " i didn`t s.a.r you pointing out that i was not who they were looking for and they could send me the information but in no way would i be paying the required £10"
i also added that i would be charging them £35 for every letter i would have to send to them from this date forward
