| | Basic Account Customer | how do i get rid of Wescot? Hi all,
It is pretty serious now, and i would like advice or some guidance or advice to get rid of Wescot.
They are harassing me for an alleged debt to Abbey. I say alleged because the same amount i am claiming as overdraft charges.
I have done everything up until after the letter before action, of course Abbey did not reply. I guess with all the hype of the OFT court case i was complacent and haven't yet done my N1.
i'm just fed up with them really, and what should i do if they file in court before i do, or if one of these door visitors comes with out a court order
Wescot are now threatening to knock on my door etc and court cases with their Nelson Partners solicitors, they claim that "they have no known knowledge of a genuine reason for debt not beig paid even though i wrote them this letter in november 2007 Quote:
I am disputing the total value of these debts with ABBEY NATIONAL PLC due to unlawful and unreasonable charges. As such, therefore, I consider this account to be in dispute and no further action shall be taken until this matter is resolved.
As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."
This process may take some time, due to the Office of Fair Trading's test case, but I will try to expedite this issue as a matter of urgency.....

You should be aware that we have written to you on a number of occasions over recent weeks regarding an outstanding balance with the above named client (ABBEY).
At the time of this letter, the above balance remains outstanding with no current arrangement in place for repayment. Nor are we aware of any genuine reason for non-payment.
It is important to our client that this balance is repaid, which is why they have instructed us to recover the outstanding amount.
WHAT SHOULD YOU DO?
To avoid this matter being escalated to the final stage of recovery, you should contact us as quickly as possible on 0870 024 0442. Alternatively, you can write to us at the address above.
Likewise, if you have been reluctant to contact us because you do not have the means to pay this debt in full, again it is important that you contact us as quickly as possible. because we arc able in many cases to agree a repayment programme by instalments. Currently, in excess of two hundred thousand account holders are taking advantage of this facility.
WHAT IF YOU DO NOTHING?
The important thing to bear in mind is that you must do something - the problem won't go away.
We are unaware of a genuine reason why you should refuse payment. If you or your representatives do not contact us, we will have no option but to escalate this matter further. The next action we will take will be to
either; •
• refer the account to a door step recovery organisation, who will write to you under separate cover, for a collection visit: or
• refer your case back to our client for their further action, which may include referral to another debt collection agency. .

File at Court, the sooner the better.
Westcot will keep sending out stuff like that.
There's a letter you could send regarding Doorstep Collections.
Please be advised that I will only communicate with you in writing.
Should it be your intention to arrange any further “doorstep calls”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
I look forward to your written response to this letter within the next 14 days, together with a copy of you Complaints Procedure or, your confirmation that on this occasion you have made a genuine mistake and your files have been closed. Failure to respond however, will see the matter referred to Trading Standards, The OFT and any other authorities as I see fit and without further notice.

No mention of Court here. maroonedevo has dealt with the doorstepper and if Westcrap refer it to another DCA then they must realise that they are unable to pusue the matter themselves
