Question 1st Credit refusing monthly payment

Hi All,

Just wondering if anyone can help.
My brother owes £160 for a mobile phone bill. 1st credit are now chasing on their be half. He has offered to pay £20 per month but they are refusing to agree the payment plan saying their client's (telephone company) will only accepy payment in full or they will issue court proceedings.
Anyone got any ideas on how to resolve this.

Send the payments to the mobile phone company and cut out 1st Crudit, does the phone company accept online payments?

I agree. A lot of mobile companies will accept the payments directly which p***es off the DCAs no end

Thanks for that chaps.
He has spoken to company direct and they have advised him of the same thing. Payment in full or court action. He does not have the funds to do this.
Can not pay online as when he enters his details it just kicks him out, so I would say the account is closed as it been pased to DCA.
What next?

1st crud are going to look pretty stoopid taking someone to court for £160 when they already offered £20 per month. Get your brother to write to them recorded delivery making the same request enclosing the first payment. If/when they write to decline, he then has evidence of thier being unreasonable.

Have they added any charge to the account?

Is your brother on benefits?

BB39 is correct I can just see the judges face when presented with this, as BB39 says send the first payment with an offer letter, then send a payment every month. Once they get their grubby mitts on some hard cash they tend to go quiet, just dont default the payment schedule.

No he is working but has three kids and just moved house. i.e. rented accommadation. With the deposit, van hire, 1st months rent e.t.c. hence can not afford one off payment.
They have added no charges yet.

DO NOT let him phone to make payment with a card as some DCAs are known to take whatever they want whenever they want when they have your card details

Also DO NOT let set up a DD. SO is ok as he has control but with a DD, they can take what they wish.

OK. Advised him to send chq. with financial statement and cover letter explaining current situation and payment proposals by recorded delivery direct to telephone company.
