| | Platinum Account Customer | Re: hfo turnbull and welcome finance cowboys Send Welcome the S.A.R - (Subject Access Request) which you can get from the link below. you will have to modify it slightly as it is asking a bank for details with a view to reclaiming
bank charges whereas you are looking for different details, though they may also have added unlawful charges on to your account by now.
Wait until you get the documents from Welcome before jumping in on the CCJ as there should be a fair amount of information from your S.A.R - (Subject Access Request) that could help in your defence of the CCJ. 1. Data Protection Act, Subject Access Request letter - List of charges
If HFO and Turnbull start getting akward in the meantime, point out that you are in dispute with Welcome as four years ago they agreed to you handing back the car as you had conformed with the conditions of the Consumer Credit Act. Tell them you vigourously deny the Welcome claims and will take them to Court if they fail to accept their agreement of four years ago.
In the meantime, as there is a dispute, under the terms of the OFT guidelines
DCAs should back off until the dispute is resolved. If they wish to continue, it will be regarded as harassment by yourself, and you will decide whether to take them to Court as well and/or complain to Trading Standards that they are unfit to hold a Consumer Credit Licence. Do not pussyfoot with them-kick them hard every time they contact you. |

If you send a Subject Access Request to HFO, they have 40 days in which to respond, assuming that they would respond at all. However, HFO have a nasty habit of going for enforcement of the CCJ almost immediately, usually by asking the court for a charging order against your home if you own it.
You need to apply to have the CCJ set aside ASAP. To do so, you need to download a form N244 from the Court [ www.hmcourt-service.gov.uk ], and send the completed form to Northampton.
How did you learn that HFO had obtained a CCJ against you? |
