Got a letter today from irwin mitchell saying they will take me to court if i do not pay £33.50 to intrum justitia in 7 days from letter (5 now since i got it today), i am desperatly trying to pay overdrafts i don't even have that.

Everytime intrum justitia ring up i tell them i do everything in writing, they guy gets assey with me saying "no you don't you went with paypal you do things online" so i said "no i do all things like THIS in writing" i have asked repeatedly "please send proof of my debt to my address containing how and when i owe the debt" they again get assy and say "you know you owe it now pay up".

Every fracking time they get assey and all they send me are debt notices to pay up, nothing like a date from when it was owed or any proof i owe it just saying it is on behalf of paypal.

Now i will get taken to court, yet they refuse to show me their own proof that for one they are allowed to claim the debt, and two when and how i owe this debt.

It's unlikely you will go to court for such a small amount, you need to send them a letter asking for proof of the debt, there is one in the templates.

Again, DONT PHONE THEM they think they know the law (but they only know parts of it when it suits them) and they think they can lie and cheat to get you to pay up Let them know if they do phone that the call is being recorded and see what their reaction is.

Here's the 'prove it' letter


Dear Sir/Madam

Account no:

You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

I/we would point out that I/we have no knowledge of any such debt being owed to (insert company name).

I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

I/we would ask that no further contact be made concerning the above account unless you can provide evidence as to my/our liability for the debt in question.

I/we await your written confirmation that this matter is now closed. Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

I/we look forward to your reply.

I am going to send Intrum Justitia the letter about asking for proof of debt.

I will send a letter to the solicitors too asking them not to contact me again i guess.

But what happens if they claim they do not receive a letter from me or simply do not send me any proof?

How exactly do i go about recorded delivery? Do i need to put my address on the letter at all, i have put the refence number the solicitors used and also my full name on it.

Bear in mind i can't even spare £2 right now, halifax charges and overdrafts take up every penny i earn spare at all

Hi,

I think Recorded Delivery costs 72p plus the cost of 1st or 2nd class stamp.

They might struggle to reply to your letter if you don't put your address on it.
They should have it linked to your reference number, but I'd put it on, just in case.

I exchanged a few letters with Intrum about one of Irwin Mitchells letters - possibly similar to yours. Apparently it was just advice about what might happen if I didn't pay, rather than threats to start proceedings, along with their suggestion that I might like to pay in 7 days !!!!!
