Default Egg Card

I CCA'd Egg Card earlier in the month and they sent me back what looks like a valid CCA.

I will scan it and upload it on Tuesday when back in work.

The only question I have in the meantime, is that my signature does not appear on it, but instead a tick box when my signature should go.

I think this was because it was done online. Will it still count as a valid signature?

Hi manc

That agreement is fully compliant with the CCA 1974 as far as I can see. As it is dated after April 2004 the tick in the box cou8nts as a signature and it has all the prescribed terms. You should have been sent a notification of your right to cancel within 7 days of this agreement being signed. Do you remember if you were?

I think I did to be honest. The good thing about Egg, is that they have been very understanding and have accepted a reduced payment and stopped all charges and interest. The haven't badgered me at any stage, so I shall continue to pay them.

Thanks for your help.

HI manc1976

Good to read that Egg agreed to freeze interest etc - can you let me know how you did this with them ie was it using the templated letters that are on here or what? The interest on this one is killing me as out of a payment of 139 per month they are taking 127 in interest - I have Subject Access Request'd them this week for charges but really want to get them to be reasonable and reduce interest and take reduced payment but am unsure whether should speak to them or write to them....

Any help gratefully received

Hi Moobelle

All I did was to send them a letter to explain the situation I was in, enclosed a copy of my personal budget sheet and a list of my creditors, a list of the pro-rata payments I was making to each of them.

I then requested they freeze all interest and charges, as it would be in their best interest as well as mine.

My OH is having a problem with Halifax where they wont stop the charges or interest and they are more than what we are paying them each month, so the debt is growing. Is disgusting!!!
