Default Debt Managers Ltd & Aktiv Kapital

Hi,

This morning I have received a letter from Debt Managers Ltd to say that an overdue account has been referred to them from Aktiv Kapital First Investment for immediate collection of £3374.22.

When I saw the letter I did assume that it was from a debt I had with Barclays nearly 7 years ago. I called Debt Managers and asked the operator who Aktiv Kapital are and who I owe money to. They confirmed that Aktiv Kapital buy debt from companies and that the debt was with Barclays from 22.06.01. I said to the operator that they only have 6 years to contact me to claim any monies from me and could I have the date he stated again, the phone line went quite and I demanded that he repeated and he did. I told him to expect a letter from me as the 6 years have passed.

Is this correct? Did I do the right thing? I have a template of the letter regarding the Limitation Act 1980 Section 5 to send to them and will send this recorded delivery. Any other advice?

Looks like statute barred. Send the letter and see what they come up with. Is it the letter from this site?

Thanks both for the advice.

I have just got off the phone with National Debt Line and they have confirmed that it is statute barred.
I was concerned as I have moved many times since 2001. National Debt Line said that this makes no difference at all. The letter I am sending is the one from this website and I will be sending it off tonight.

Seems strange that I have just closed my credit card and finished paying a loan, now they get in touch!

Same in my case and they confirmed it was going to be refered back to activ kapital. So waiting to see if hear from them also. They are very evasive with info and I wonder are they just a tracing arm of activ. Waiting for round two!!

Even if they refer it back to Aktiv Kapital it makes no odds as they didn't have any contact with me over the 6 years.
Either way no one is getting any money out of me. They probably are just a tracing arm for activ. I have always been on the electoral register so they haven't looked very hard!!

Hi 1st post so be kind! I got a letter on 20th July 08 from Debt Managers Ltd, working for Aktiv. I immediately phoned them up and they informed me it referred to a debt from 1998. I denied all knowledge of it as I was living in a shared house at the time and anyone could have had access to mail and personal information. The woman was quite hostile, asking several times if I would make "full and complete payment by credit or debit card now to sort this matter out". I declined and said I wouldn't be paying. She finished the call by saying she would refer the matter to a "doorstep collector". After discovering this forum, I sent Letter N, by recorded delivery with a £1 P.O. (possibly letter M would have covered it also)
Got a reply this morning saying that "We are no longer dealing with this account. We also return the £1.00 fee paid"

Thanks to everyone for a great site!!!
