Default bcw/thames credit/statute barred debt

six months ago received a threatogram from these muppets ref a lombared tricity account
wait for it, its from 1998

after some heated words, informed them account statued barred, and will be making no payments as i do not reconise the debt.

they said they will be returning the account.

received a letter from them this morning demanding payment, legal action etc.

what i would like to know is can they default me

just spent the last 12 months, thanks to cag, getting a clean credit file

even though i have allready informed them statute barred, can they keep passing this account around dca, threatning legal action, when there is no legal basis for them to do this

Exactly the same has happened to me, Thames demanded statute barred debt for Tricity finance. However they have defaulted me.

Hi

I really dont know, that was to be my next post. Thames have not replied to me at all but are collecting on behalf of Hillsdens. Lombard too defaulted me and that dropped off 3 years ago so im really not sure. Although i would say not, i dont know what to do about it. Im sure some one knowlegable will be along soon to answer that.

they cannot default you for a staute barred debt

inform the CRA and the muppets chasing you that they must remove it,or you will get a court order to make them do so

I'm not sure,but I would go along the lines of

Dear Sir

Re XXXXXXXXXX

I note that a default has been placed on my credit file with XXXXXXX CRA in respect of the above statute barred debt.

Statute barred debts are by their nature unrecoverable at law,and therefore your placing of a default flies in the face of the laws of this country.

I require you to remove said default forthwith,and refusal to do so will result in action being taken through the courts to ensure that you do comply with this request.

called bcw yesterday and asked them why they were demanding payment.
this was settled six months ago
i mentioned again the debt was statute barred as they well know,
no explanation, only they will be ending the account
great these people, arnt they.
demanding payment in the face of all reason

also, i know this was posted last week but got a great offer, debt cut in half if i pay within seven days, i think knot

i doubt they will keep there word about ending the account and will prob receive another demand again in six months

they dont like to give up, do they

Before contemplating court action you can demand of the CRA that they remove the default. That way once informed yet refusing to comply you can also have a go at them or even cite them as joint defendants in any action you might take
