Hi,

Firstly I would like to say how grateful I am for finding this site. I have read through, and am somewhat confused as what I should do, as each case is individual.

I took out a loan with Lloyds tsb in 1998 for £5000, also had PPI which due to being young and naive did not understand at the time. I paid this for over a year, then due to a break up I could not afford it. The debt was passed to Wescot Credit services, and we came to an agreement of £50 per month. I paid this for almost 5 years. I then found myself unemployed, and wrote to them asking them to consider writing off the debt, and said I would make a token payment of £1 per month until my situation changed. I heard mothing, despite several letters to them, so I sent no further money. Several months later I was contacted by 1st Credit, several letters back and forth, I agreed I could send £10 per month. Then out of the blue I received a statutory demand from Connaught! I contacted them, and again said I could only pay £10 per month. They cashed my first cheque, but have now sent back the second telling me they will not accept it, and it is 'their intention' to contact a solicitor to issue a bankruptcy petition. I am not presently working for personal reasons, and am not claiming benefits, I am very lucky to have financial support from my parents.
So after all the waffle (apologies) I was wondering if there is anyone who would be kind enough to help me, with a guide of what I should do next.

Thanks for such a quick response.

The statutory demand was sent 29/10/07. They have cashed a cheque I sent them since that date.

I intend to send the CCA on Monday by recorded delivery. I hope I do not sound stupid here, but should it be sent to Connaught, or to Lloyds TSB, or both?

Hello there

the CCA request should go to whoever is pursuing you for the debt at this moment in time,

my concerns are that you only have 18 days from memory to apply to the court from the date of service to have the stat demand set aside. then they can petition for Bankruptcy

its not something which should be ignored thats for sure,

that said the Stat demand should be served correctly

im going to refer to my law library to see if i can pull a few books on BR etc and see what i can come up with,


i will also alert a few others who are more knowledgable in this area

Thanks, I have looked at that site. Connaught are clever in the way that they word things, in order to try and baffle you. I only wish I had found this site earlier.

I am going to send the CCA.

As I said earlier, they returned my last cheque to me, should I resend this?

DO NOT send them any money until they can PROVE their legal right to collect this debt.
This is achieved by their compliance with your CCA request.

Are there charges on the account (I would be very suprised if there weren't as reduced payments have been made). Was the PPI missold e.g. it doesn't cover you or you were not fully informed of the policy or the possibility of not having PPI?

Hi Rory,

The original loan amount was £5000, and with PPI added. They are claiming an outstanding balance of £4358! (from the top of my head I have paid back over £4000)

I cannot say whether I was missold it, it was quite some time ago, and all I can remember was the advisor in the bank telling me that I really needed it.

As soon as the debt was passed to Wescot Credit services, the interest was frozen.

we sent connaught a letter on the 2nd December 2007 asking for a breakdown of the monies we owe they have not responded to this letter
can we sit tight our should we have done a cca?
any help would be appreciated
