| | Basic Account Customer | OH GOD!!! LLoyds loan last paid 5 years ago..Letter received today from Lowell? Help! Hi! I have never ever used a forum before..only just read through them! But now I am desperate for some advice??
I took out a loan with LLoyds Tsb back in 1998/1990? That long ago can't remember..... Anyway was paying Bains & Ernst for a few other debts and payments to them stopped in oct 2002 due to my Father dying with Cancer and I moved to Bristol to be with him, leaving job, friends, family etc behind...Anyway..Long Story short, Today...29th Nov just received a letter from Lowell financial saying that they have bought the debt from 1st Credit (original LLoyds TSB) for £3000 and they want me to call them to pay it off! I've lived hear at my present address for 5 years and had no correspondance from them till now! Jst been to court after ex (whom I lived with) had paid a nursery bill for my son (not his child though) and despite the Judge not having any evidence presented to him awarded in his favour (his word against mine) and I now have 1 ccj against my name already! So I know they don't need proof??? Begging for any advice!!???

Before you even think about making any sort of acknowledgement or payment to a DCA you MUST ensure that they have the LEGAL right to collect the debt.
This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

Is it important to start the letter: I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.
It is best to send this request via recorded/special delivery as there are some inportant deadlines to observe.
After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.
If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action once the DCA continues to demand payment.

Just wanted to pop in and say that you will get all the info you need on here!!
I've only posted a couple of threads but with some sound advice from the boys and girls on here I am getting my finances in order for the first time in years!!
