Default OH GOD!!! LLoyds loan last paid 5 years ago..Letter received today from Lowell? Help!

Hi! I have never ever used a forum before..only just read through them! But now I am desperate for some advice??

I took out a loan with LLoyds Tsb back in 1998/1990? That long ago can't remember..... Anyway was paying Bains & Ernst for a few other debts and payments to them stopped in oct 2002 due to my Father dying with Cancer and I moved to Bristol to be with him, leaving job, friends, family etc behind...Anyway..Long Story short, Today...29th Nov just received a letter from Lowell financial saying that they have bought the debt from 1st Credit (original LLoyds TSB) for £3000 and they want me to call them to pay it off! I've lived hear at my present address for 5 years and had no correspondance from them till now! Jst been to court after ex (whom I lived with) had paid a nursery bill for my son (not his child though) and despite the Judge not having any evidence presented to him awarded in his favour (his word against mine) and I now have 1 ccj against my name already! So I know they don't need proof??? Begging for any advice!!???
Do I contact them?

Send them this by recorded delivery and remember NEVER talk to these idiots on the phone as they will try and get you to agree to anything.

Before you even think about making any sort of acknowledgement or payment to a DCA you MUST ensure that they have the LEGAL right to collect the debt.
This is achieved by requesting a copy of the Signed, Executed Credit Agreement via a Consumer Credit Act (CCA) request.

Is it important to start the letter:


I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY in Big Bold letters.

It is best to send this request via recorded/special delivery as there are some inportant deadlines to observe.

After 12 WORKING days the "debt" is in default and stays that way until the request is complied with.
If a FURTHER month passes then the DCA has committed a summary criminal offence and the matter should be referred to Trading Standards for action once the DCA continues to demand payment.

Hi There! Thank you for your prompt reply, Ihave noticed you on many threads and recon you may just have a halo above your head lol!

Right I will write this out and send it on to them. What are the chances of them being able to get the Credit agreement? It appears they bought the debt off 1st Credit who bought it from Lloyds?
Its totally bizare why it has taken so long to catch up with me as I still actively bank with Lloyds at my present address?....

Recon it looks like I'm facing a 2nd CCJ! Merry crimbo to me hey!

But thanks again for your reply, head in oven is looking appealing!

Hi FinancialNinja! Great Name!
Well don't know what to do, everything from when I was alot younger is catching up with me and biting me on my a**.
My own fault I know but Tried so hard to get my life sorted since my Dad died! I had genuinly forgotten about this debt as was just over 5 years ago since i last made any payment or heard anything about it?

You all seem to have loads of fight in you, me on the other hand...all out of the fight stuff....

Just a thought...can anyone tell me If they can produce a cca from 1998/99 how long would it be for them to get a court date? Oct 08 would be 6 years since last payment? Would I have a hope in hell of delaying court for that long?

To start with just do as ODC said. And yes he does hav a halo above his head. Bless. Please the guys that have been here a long time have come through a lot and a few with a couple of war wounds. They do their stuff insid out. Honestly rasther than question it just do it and sit andwait. At least you are being pro active. The letter ODC mentioned will put your debt into dispute. At the very least it will buy you some time to sort things out. All the letters you need are written for you.
