Default Lowell Finance Again

This is my first post so hello to you all.

Can anyone help please.

I have a Capital One £2000 debt which I was paying £50 to on a payment arrangement. One month I couldn't make the full £50 so Capital One sold the debt to Lowell Finance. As with many other members here this despicable bunch of low life started their camapign of commercial terriorism.

I have done the usual request for a copy of the agreement etc. and also told them in writing not to call me or I would bill them £55 per hour for sales and marketing advice which is my trade. As you would suspect they are still ringing and hassling me. I have never acknowleged the debt.

I asked for a copy of the agreement and proof of loss within 12 days or the matter would be dropped. 16 days later I received a very poor photocopy and no proof of loss. They are in default and know it.

At the same time as this is all going on I have continued to pay Capital One £60 per month. They say they don't want it but accept it anyway. I kept a paying in slip and photocopy it each month. I have always refused to deal with Lowell Finance and will always do so.

My question is; is it advisable to continue to pay Capital One? Is there any benefit in doing so? Or shall I stop and pay nobody?

Lowell Finance are in default and haven't proved the debt against me or any authority to do so. I'm also going to invoice them £55 for calling me today as they knew I would be taking it that they wanted sales and marketing advice as per my letter and offer of contract.

As Lowells would probably have asked Capital One for a copy of the original agreement, it may well be that the original is no longer available. Or it could be that even Cap One don't want to have dealings with Lowells and didn't supply a copy because they had the hump about the small amount of money they perhaps paid for the debt. Who knows?
On balance though the likelihood is that the original has disappeared. So if
twelve working days [ie. no weekends included] plus two days plus a calendar
month have elapsed since you sent the CCA request, you can if you want
stop paying. Though it may be safer to CCA Cap One first to be on the safe side.

You can continue paying them, as long as you have not has a notice of assignment by recorded delivery

whether it is advisable or not... is up to you and your particular moral beliefs. You are under no legal obligation to do so if they are in default of a valid CCA request.
