Summary Cause Summons

Hi,

I'm hoping someone on here can help.

I received a Summary Cause Summons under my front door last night and I need a bit of advice on how to deal with it.

Basically, I can pay off the money in full (well I will be able to as of tomorrow when I get paid), but I need to know a couple of things.

1) The amount they are claiming is "£105.75 with interest on that sum at the rate of 8% annually from the date of service and expenses together with compensation for late payment in the sum of £40.00".

So how do I work out exactly how much I'm due?

2) Do I make payment to the pursuer or their solicitors?

3) If I make payment in full tomorrow, will I have to go to, or be represented at, court?

The return date is 18/09/08, which is why I'm hoping I have time to resolve this without anything reaching court?

Hi,

1. Here's a 'link' to the spreadsheets, I used (Scotland Simple Excel)

6. Interest calculation spreadsheets

2. I would pay the persuers Solicitors.

3. If you pay the full amount you will not have to go to court.

I'll try to find out how much the Interest is

At 8% that works out at £4.91.

Obviously that goes up daily though, so should I phone the solicitors and ask them for a settlement fee?

Hi,

If you have the date when they are claiming the £105.75.
Put that in the calculator and it will work out how many days since and add up the Interest.

Or, like you say, give them a phone to find out exactly how much your due.

Yeah, that's what I did, £4.91 as of today.

I'll phone them on Monday and get a final figure. So if I pay this on Monday, it will be over with and nothing will go to court?

Ok, I've just been speaking to them and on top of the £105.75 and the £40, I've now got to pay court and sherrif's officers fees which bring the total to £322.

Does that sound right? If that's what I have to pay then fair enough, but I just want to make sure I'm not paying for things I can avoid?
