Advice?

Hi Everyone,

I'm a long term reader and newly signed up member. The advice we recieve on here is incredible, well done everyone.

My problem is as follow:

I have been paying two debts by installments to the debtors themselves. I have replies to every letter from NCO, who claim to be acting on behalf for the debtors, advising them that the debt is getting paid directly to the debtors.

I recieved a letter this morning from S.C Leatham-Locke LLB, based in NCO offices by the looks of the address, stating that they intend to take further action.

I'm really at a loss to why they are even writing to me if i'm paying the money direct?!

Does anyone have any advice?

Just a quick correction. You have been paying the creditors - you are the debtor.

What does the letter actually say?

How much are the debts for toughly and how much have you been paying per month?

What are the debts for and are there any penalty charges on the accounts?

Thanks for your reply and for your corrections.

I'll re-type the letter when i get home this evening as i'm not carrying it with me.

The debts are:

1 - Vanquis Bank - Intrest on this account is frozen and repayments of £47 per month are being made - Outstanding balance £750

2 - Orange Plc - No charges or intrest is beiing added to this account. I am paying £25 per month - Outstanding balance £800

I hope this is the information your needing. Have i missed anything? I am intending to pay them both of by the end of the year in full to the creditors. I have a few debts and i just recieved a pay increase so i'm going through them one by one and paying them off in bulk.

What does the letter from S.C Leatham-Locke LLB actually say?

Normally this is a scare tactic by DCA's to try and get you to up your repayments, whether you can afford to or not. If you are paying what you can reasonably afford then there is no point in them taking further action as a sheriff would not award them higher repayments and may in fact even reduce your repayments if they think they are too high.

The letter says:

Confirmation of Further Action

Take notice that our intended alternatices have previously been ade clear to you and we will now reccommend that further action be taken on your account. We are therefore suggesting that your file details should be passed to an outside field agency to finalise resolution of this debt.

Please quote your refrence number with payment.

YOU HAVE 48 HOURS TO PREVENT THIS RECOMMENDATION

After this it contains a giro slip.

Okay you can do one of two things. You can file the letter under ignore or make an official complaint in writing to NCO. Personally I would make a complaint to NCO on the basis that you are paying what you can afford to their client and you view this recent letter as harassment. If they don't resolve your complaint to your satisfaction after 8 weeks you can then report the matter to the FOS.
