The claimant did not file any evidence with the defendant and the courts refused to make the claimt do that. When CPR was mentoned the judge said what is that?
Thats incredible, how can a judge not know of the Civil Procedure Rules?

this is why we have legal professionals, solicitors , Barristers etc

i would bet a tenner on it that there was some failure to follow procedure on your friends part GM that lead to the issues in hand. I also have difficulty in believing that a District Judge knew nothing of the CPR, ALL District Judges are qualified lawyers and would have grounding in the CPR and also would have access to things such as Blackstones or the White Book etc so its inconceivable that was the case.

pt, theres a couple of threads that seem to have taken on a general whinging type of stance, whilst im all in favour of there being one or two, i do agree that when it hi-jacks someones thread to the extent that the original plot is lost then its a bit ott.

Perhaps it would be good to have a general type of thread were everyone concerned with legal/general debt etc could express thier general views.

Dont know how to achieve this but there is definately a need for it judgeing by the amount of these typs of posts?
