| Re: Nationwide/kpr Cca Request- now a Court Claim Sorry here is the latest one Draft Order for Directions The Claimant shall within 14 days of service of this order send to the Defendant and to the Court: 1. A true copy of the executed credit agreement and any other document(s) referred to within the agreement. 2. True copies of any default notice and cancellation notice that you sent to defendant together with a copy of any proof of postage that you hold.
3. A full breakdown as to how the amount claimed has been calculated, including all payments made and charges applied throughout the duration of the agreement.
. 4. Any other documents relied upon If the Claimant fails to comply with this order, the claim will be struck out without further order.
The Defendant shall within 14 days thereafter file and serve the following- An amended defence sufficiently particularised in response to the documents supplied by the claimant
If the Defendant fails to comply with this order, the Defence will be struck out without further order. |

Another question for you all, i'm going to to take my A/Q into the court tomorrow, i'm thinking of asking if the claimant has filed theirs yet, if not can i ask for their claim to be struck out? I know that they would have my defence struck out immediately if i don't file tomorrow.
Can i do this? would it be wise? any comments welcome |

IT IS ORDERED THAT
Unless the claimant files an Allocation Questionaire by 4pm on 5 may 2008, the claim shall be struck out. |

when you speak to the court manager ask if the claimant has filed an AQ as directed by the judge
if they havent, then ask for the case to be struck out without further order, the court manager has the power to do so , so if they refuse refer them to the order by the judge
