If you suspect fraud you need to get a crime reference number. The police will take your details and phone you back later and just give you the number and tell you they wont do anything.
Now with this number you can then phone the financial ombudsman. They will then do something. They did not even take my complaint until I had this! In the acse of 1st Credit they have written to them and told them to stop any court action until the complaint has been investigated properly.
i am now waiting to hear from 1st credit.
The solicitors complaints people also then took my complaint against 1st credits solicitors.
Prior to this i got nowhere.
In my case also the CCA was never supplied.

| Re: Rockhag Vs Bryan Carter & Co Solicitors. I received this letter from Bryan Carter today: "Please find attached for your information, a copy of the Notice of Discontinuance forwarded to Sunderland County Court." I guess this means I've won then?
Am I right in thinking that when I get confirmation from court that I will then look into counter claiming for costs incurred, to get the ccj removed fro my credit history and an apology??? Will I be able to claim my freelance rates for the 18+ hours I've spent on this as well???
I'm so relieved I can see some kind of closure to this.

WHOOOO HOOOOOO CONGRATS its game over Carters have given up, what a shame
im afraid i cant advise on the issue of costs, i always look upon it that where they have discontinued its best to let sleeping dogs lie, so to speak
however, i am sure there will be others who are happy to help you with the costs etc
im pleased youve got the result

paul | Thankyou Paul. Think is this has cost me over £100 so far in court fees, phone calls, postage etc. so I at least want that back from them. I also want that CCJ removed from my credit history as well, so I have no idea how to go about this as yet.
It is a relief however. I was filled with dread when I saw the envelope in the post but I did a little dance once I'd read the letter. :P |
