| | Classic Account Customer | Re: Womble 72/Northern Rock 29k Debt - Court looming. Hi Paul,
Because of the claim being over 5,000 do i ignore all three tick boxes and leave it blank.
Quote: Track
tick small claims as long as the claim is below 5000
One more question.
Section f on the form
Quote: Section F - Proposed directions Attach the list of directions, if any, you believe will be appropriate to be given for the management of the claim. Do i need to tick the yes box ?
I am clueless with this part and dont really understand what it means.
I know your busy Paul so i let respond when you have the time.
As long i send it in by the 31st December.
Much apreciated with your fantastic help Paul.
Kind Regards
Womble |

| Re: Womble 72/Northern Rock 29k Debt - Court looming. Quote: Section A - Settlement
tick no
| Quote: Section B - Location of Trial
tick yes, in the box put that you respectfully request the case be heard at your local county court wherever that may be as you are a litigant in person
| Quote: Section C - Pre-action protocols
tick no in part 2,
| Quote: Section D - Case management information
amount of claim in dispute, you should be able to answer that
| Quote: Witnesses
yes you so enter your details as a witness of fact
| Quote: Track
Multi as the claim is over 15000
| Quote: Section E - Trial or final hearing
1 hour for the hearing as a guide, to be honest i have no bench mark as to how long it will take
if there are any days you are not available let them know
| Quote: Section F - Proposed directions Attach the list of directions, if any, you believe will be appropriate to be given for the management of the claim | Quote: Section G - Costs
leave blank | Quote: Section H -Other Information
this is for any information to bring to the judges attention which the judge may use to help him deal with the case |
ive gone through this again and updated it womble
i cant think of any directions off the top of my head to ask for, but dont worry because the judge will most probably order standard directions for disclosure and you will be told what you have to do
regards
paul

| | Basic Account Customer | Re: Womble 72/Northern Rock 29k Debt - Court looming. hello womble,
About the time estimate. I recently attended a hearing which was down for 3 hours. The judge came in - looked at the bundle and said he did not have enough time to consider the matter and ajourned the hearing with a direction for another hearing with an estimate of 2 hours reading time and 3 hours hearing time.
Considering the issues you have to get through that might be sensible in your case. ie Quote: Section E - Trial or final hearing
Reading time 2hrs
hearing 3 hours
if there are any days you are not available let them know
|
I would expect to be at the court all day with this one. |

| | Classic Account Customer | Re: Womble 72/Northern Rock 29k Debt - Court looming. Hi,
I have now sent the questionaire and my defence to the local court.
So now i just sit and wait.
I have to be honest and this is getting to me and it feels a lot worse than a visit to the dentist.
I have read Tom's link about a day in court but i am worried.
So i will have a really good christmas with my wife and two young children and let the battle begin in 2008.
Everybody have a good christmas and i will speak to you all soon.
Many thanks again to the Cag team and especially Paul and Tom and moral support from Benson.
And everybody else who have been on here for advice and support.
Many Thanks
Womble & Family |
