just an update
the personel loan account that was sold to a dca has just been returned back to welcome. prob due to court claim or i made noises about claiming charges, ppi, etc direct from dca

as you know i had to alter my poc, welcome said original claim to vague, common tactic. i have an application hearing in a coupple of weeks. what does this exactly mean. i thought they would just accept my new poc. why an application hearing.

also, i know i keep on about this but has any one actually got welcome into court, and have they ever turned up to defend. the reason i ask is that i keep on getting no imput on this question. in my opinion welcome seem content on selling to a dca

i've got a full hearing date in feb but i don't know of anyone else who's got that far.

i've spoke to mr palmer in their legal dept and i get the impression they're gonna turn up for my case. he seems like a nice chap though and isn't arrogant like some of the banks legal staff were.

only problem is that it bulk listed and so we'll probably be there all day waiting for case to be heard which is a pain.

interesting thing is that the court schedule similar claims in bulk so it could be that there's a couple more ppi claims on the same day.

i'll start posting more details on my own thread tonight which could help others 'MCFAD vs Welcome (court stage)'

see the hmcs website about which track a claim should be heard in, the court will decide but you will need to argue your case eg for small claims at that hearing so make sure you do your homework, WF will try to force another track so that they can scare you with as much charges as possible.

looks like our claims are on the same time scale which is interesting.
c palmer is dealing with mine also, like u said polite chap
thought i would mention have got rid of dca handling one of the accounts, sent back to welcome

quick question
welcome have begun updating the cra with default notifications.
i tackled welcomes compliance department over this as i had served a section 10 data protection notice on them. there compliance officer went on the defensive on this saying they had a duty to update my cra files as of the terms of the account were broken. i informed him i had withdrawn my consent to process this data and as the account were subject to county court proceedings they had breeched that notice.
before i send a report to the information commisionaire can any body tell me where i stand on that notice and there assumption that they can ignore that notice

all this claim is about is getting the defaults removed.
i think its about time i put more pressure on welcome
on one of the accounts the default notice states 18500
on my credit file states 8000
its obviouse the default notice is incorrect
i believe damages for this is 1000 plus the value of the default
the default notice is on page 8
any comments please, and on the data protection issue above

Your Credit Report Help Centre, from Experian UK

Status codes query? status 8, according the this site means your agreement has ended and you have not made any efforto pay (read exact wording) so why do some lenders report this status 8 when creditors are still paying but may have missed around2 or 3 payments and then continue to pay??

it seems to me that this is misinformation, creditors are arguing they have the right to process a default without a default notice just for falling behind but this does not seem to me that this is the correct meaning of the information on this site, any ideas.

ok people i need some urgent advice
up in court against welcome this afternoon ref application hearing
cheeky buggers sent a list of costs which i received tday by special delivery
they are sending someone to court
looks like they are trying for fast track for costs
as this is not a claim about money i need advice to keep it in small claims

welcome wanted fast track and asked for 500 costs
judge had none of it and allocated small claims
