Default Currys Sold My washing Machine!

Purchased a washing machine from Currys in the Jan Sale, it was agreed they would keep it in the store for a few weeks whilst we moved into our new home. Came back a few weeks ago to collect and they had sold it. The model has now been discontinued, they just said well you can either have the display model or a refund and go get another machine.

Trouble is the machine was very compact and we choose it becuase we could intergrate it into out new kitchen, plus it was quite a decent speck. So to get the money back £200, we would have to put andother £100 plus to to get a similar machine.

We tried to complain to the manager to he was having none of it, so have had to take the display model, just about to write a letter to head office now can anyone help, what bit of law sould i be looking at is it the the supply of goods and services act?

They have breached their contract with you which if they refuse to rectify would cost you money.

This they cannot do. - I should write explaining your situation & if you don't get a satisfactory response threaten them with TS

If they have offered the display model then it should be further reduced in price as being 'shop soiled'

yeah thats what i was thinking, thanks for the advice ill write asking for a further reduction and 1 years extended warranty to cover the wear and tear the machine has suffered on display

High a reply back today from Currys basically saying that it was my fault becuase i left the machine in the store for so long even thought they had agreed to store it for a few weeks, and as the machine was already heavily discounted (in the sale) they wont give me anything.

Where now ? issue a small claim against them for breech of contract, can I claim compensation? )

If not try & find another very similar machine & if it's more expensive you could sue for the difference

nope paid cash, yeah ill try and find the model that suceeded the one i have and ask for the difference. Such a pain though, why cant they just say sorry for the fudge up here s 50 quid for the hasstle and on ya way.

Refer it to Consumer Direct. but ake it clear that you have already had a response frm the manager that you are not happy with. You should be entitled to get the additional cost of the machine that you originally paid for. The fact taht it was heavily discounted is not an issue imho.
