Default konakona Vs Thames Credit LTD (HFC)

Back ground
Another one which we're not 100% sure on the origins of
We had so much on credit that after everything went pearshaped we kind of lost track of everything. Between our really bad accounting system (system being used in the loosest terms) and the amount of letter DCAs send and the how often they sell the debts on, its hardley suprising really!
The poor book keeping problem is a lesson I have truely learnt, shame I did'nt learn it a few years ago though.
This debt has been paid regularly over the last 4 years, however it has constantly yo-yo'ed in price, but is currently at its lowest ever!

Whats happened so far

CCA request posted yesterday (11/12/07) by recorded delivery

Looks like you're getting the idea on this lot.
Now if this is for a Card then the chance of a compliant CCA are small, but I have found that HFC loans ted to be CCA complaint and enforceable.

I'm looking forward to their "co-operation" Curlyben!

I've just noticed that the debt on this letter has gone up £4 from the last letter, would I be right in thinking thats a bit naughty?

Hey doesn't matter at all.
Until they can prove the debt it can increase by £400

Even after they do, assuming CCA is correct, they cannot increase the debt without a specific contractual clause for doing so.

Sit back and give them the rope

It's sweet when they pass the 12+2+30 calendar days

Work out your deadlines from the date they say in writing they recieved your letter, that's 12+2+30 calendar days (unless the last day falls on a sunday), keep that letter VERY SAFE . If, after the further 30 they demand payment report them ASAP
to Trading Standards, here's the link:
Trading Standards Central - Trading Standards and Consumer Protection information for the UK

In the meantime, scan and post anything you get from them here and we'll advise accordingly.

Have a great Christmas and New Year
