Default Advise Please

Hi,

A friend of mine recently purchased a hd ready tv from currys.

5 days after he purchased the tv he noticed that there was a sale on for the same tv with loads of extras for them same price he had paid a few days earlier.

He tried to return the tv saying it didn't fit his needs but currys have point blank refused to take the tv back.

Is there any way around this one?

Many Thanks

If it was bought online or over the phone, then he has an automatic right of return covered by the distance selling regulations.

If he bought it in-store, then, unless the contract allowed for a no-quibble return, or there is something actually wrong with the TV (not as described, not fit for purpose etc) there is nothing that can be done without involving some element of fraud (which is condemnable and therefore not suggested) or a monumental fight (if you were told there was no sale coming and you relied on this then you may be able to argue a case but proving it would be near impossible).

If there is a refund policy, the terms will have to be looked at. Some don't allow returns during sales for the very reason of what's happened here.

I work at Currys and the company has a 7 day price promise garentee meaning that if the product goes down in price at Currys or any retail store which has stock to take away then the difference will be refunded as well as 10% of that difference.

Mention this to your friend as there will more than likely be POS explaining this if it isn't allready mentioned on his red reciept wallet.

If your friend is wanting to return the product for a refund or wanting a price match on an internet price then Currys don't really have to do anything. (Unless borght over the phone or online) as mentioned distance selling laws apply.

A word of advice however, make sure your mate goes within 7 days of purchase so he has a leg to stand on. Also make sure he goes back to the store that he borght it from not a different one.

This is because any refund or discount will dfirectly affect the bonus of te store you return it to, therefore if it is a non faulty refund then the store that you are trying to return it to will not want to know.

If you need any more help or any more advise on policies etc then just give me a shout.
