Cca Request. 12+2 (working) Then 1 Calendar Month, Unforcable If Not Complied With



What Is Subject Access Request Timescale.if Nothing Been Sent.

for a S.7 Data protection Act request or S.A.R - (Subject Access Request) as its refered to the time limit is 40 days as in calendar days not working days to comply

if they have not complied with 40 days then thy are commiting an offence

So Is The Offence Similar To The Non Compliance Of Cca, Or Will It Be Via The Data Act Itself?
Sorry, But Could You/ Someone Else Actually Write It Down For Me(parter).
Thames.Subject Access Request 16th July.........they Wrote Back Stating They Required Partners Last Addresses, I Wrote Back (as Him) Stating Will Not Be Doing Their Job For Them,therefore Timescale Still Ticking...........obvious ly Timescale Well N Truly Gone, So How Do I Write It In A Letter?

Btw, They Havent Wrote Back Since I Send The Last Letter, But Think They Will Ignore It, And Go Straight To Litigation(though I Have Kept All Letters).also, Did Not Get A Deed Of Assignment, In June He Got A Letter Saying Activ Bought The Debt From Hfc(dixons) Therefore Do Not Pay Anything To Hfc Anymore(he Wasnt Paying Anything To Anyone At The Time Because Of Unemployment

ok lets try and sort this out.

when you send a Subject Access Request the company has to comply within 40 days. they have a duty to confirm that they are sending the data to the correct person so they are entitled under the Data protection act to ask you to supply evidence of identity. it would appear that they are trying to verify his identity or atleast that is what they would say i expect if you were to issue proceedings for non compliance , i know it appears thattehy are trying to frustrate and delay things band that may indeed be the case but as far as the Data Protection Act 1998 goes they are indeed entitled to ask these questions to confirm his identity.

Ok, I Can See Your Point In 'they Need To Verify' It Is Him, But I Think They Should Already Have His Details, Or Ask Hfc, Simple As, Hfc Knows He Was Here, So Why Do They Need His Last Addresses? The Loan Was From A Different Address But Hfc Found Him At This Address, Now Activ/thames Are Supposed To Own The Debt.......so, I Cant Understand Why They Want Last Address, Because There Is Already A Link To This Address( Last Address For Him 2 Years Ago).

Ok, I'm Gonna Write Back And Ask For The Cheque Back (Subject Access Request) So I Can Pay Hfc For All The Information Instead....then See What Happens, Though I Will Also Let Them Know Their Timescale Was Up Over A Month Ago.
