Default Removal of defaults and errors

I've just got access to my Experian credit report. It makes interesting reading. There are a few errors on it.

Issue One
I live in Cardiff and there are two streets with exactly the same name and both are in districts/areas with exactly the same first four letters (one is Pentwyn, the other is Pentyrch). For years we've been getting letters addressed to us but intended for someone else. We always thought that he may have been a previous occupier, even though my partner has lived here for at least 15 years. However, my credit file reveals that this person actually lives over at the other address because he's listed on there as having been the victim of ID fraud. So this entry obviously needs removing from my file.

On top of that I have a default notice on file which belongs to this guy. I received a letter at the start of the year which was originally addressed to this other address, but it had my name on it. We received it after the address had been scrubbed out and our address written on the envelope. Believing it was for me but not sure what it was for, I contacted the debt company who sent it and they told me that it was for Great Universal ... I've NEVER had an account with Great Universal. I told the debt company and I haven't heard anything since. So I was a little surprised to see this on the file AND that it was still being updated.


Issue Two
There is a NEXT catalogue default on there which still shows a balance of over £380. This hasn't been updated in 3 years. The balance should be zero since it was paid in full a long time ago (probably 3 years ago).


Issue Three
There is a Capital One default. I stopped paying back into this account after being hit by up to £40 in charges a month. I was about to request £360 back but came to an agreement earlier in the week with Robinson Way to pay a reduced balance over 12 months. The reduced balance gives me more of a rebate (by about £50) than if I got the £360 taken off the account. However, I now need to try and get Capital One to take the default off the account. What's the best option?


Issue Four
NatWest Bank have put a default for £470 on there. This is all charges they allowed to accrue on the account AFTER I'd told them to close it. I'm looking to claim back £600 in charges from them. What can I do about this default?


Issue Five
Not sure if anything can be done about this one. My largest debt by far is with Littlewoods catalogue. It's around £2300. I received a letter a couple of months ago (first one in ages from them) offering to accept £50 a month, which I don't mind paying (can't find it at the minute though). My issue with them, however, is their irresponsible lending. My partner, who has a major problem when it comes to money (I've even had to ban her from doing the weekly shop at ASDAs - I do it all), had access to the account. The account started off with a credit limit of just £200. Because I was deemed a good payer, they increased the limit ... time and time again without notifying me first (it's an issue I have with ALL lenders - wondering if it's a breach of contract to do so). Every time they increased it, my partner also had to spend it (she can also be deaf - never seems to listen until it's too late). When I realised that we were going to end up with some problems with this account, I asked over the phone to reduce the credit limit - they refused.

Is there anything I can do about this one?


Any advice on the above would be appreciated.

Issue 1 and 2-You need to alert Experian to both these points.Do it in writing.

Issue 3 Cap one are unlikely to remove the default,read some threads about those currently with the same issues.

Issue 4.Can you prove the charges accrued after you asked them to close it ?
They will insist that they were applied correctly.You could Subject Access Request them to see if theres anything in there.But its likely you could only do this with a Court Order.(removal)

Issue 5.They will argue that you did not object nor contest the increase at the time.They will argue also that YOU were responsible for the maintenance of your account therefore should have controlled it.

Again,you would need to prove that you asked them to reduce your spend limits-it should have been done in writing.

Well, this is the draft letter I'm planning on sending to Cap One ... Any comments?


I am writing in relation to a default that was placed on this my credit file by Capital One. As the problems were directly caused by grossly excessive charges being placed on the account, making it both impossible and pointless to keep up with regular payments.
The Office of Fair Trading has since ruled that credit card charges should amount to no more than £13, but that even this could be challenged as being an unfair and excessive charge. An examination of the statements recently supplied by you show that on some months you were charging £40.
The debt has since been passed on to Robinson Way, with who I have finally reached an agreement whereby the balance requested is very close to the actual amount owed after all the charges are removed from the account. However, after examining my credit report I have discovered a default placed on there from London Scottish Bank, the parent company of Capital One, over a situation that Capital One directly caused with your excessive charges.
I am therefore requesting immediate removal of the default from my credit report. Failure to do so could lead to further action and further costs.
