Default Alliance &Leicester bad credit rating

Hi

In Sept 2007 A&L closed my account without warning. I complained to FOS and was given £100 compensation.

There is an outstanding amount on the account (current account) due mainly to them giving me money that wasn't there..........
they closed the account just before my maintenance was due to go in I asked for it to pay my bills IF it had gone in and they gave it me but I had no access to check the account and it then transpired that it hadn't gone in.

I also filed a complaint about charges but this has just been put in the pile.

Now they have done no more about the outstanding balance and in theory they owe me more than I owe them but they are marking my credit files every month with a "3".

Can they do this considering the account is in dispute?

sadly they can,
BUT
What they cant do is "default" your account, this is against the banking code of practice. Halifax are doing the same with me, i have £1500+ owing but they will not place the account in default

All the "3" means is your 3 months behind on your payments, and it will stay like that. it will become a default on reaching "8" which wont happen.
and if it did happen then you have them by the curlys.

It is so frustrating when I have made such an effort over the last year to make all payments on time to have A&L ruin it all with a load of red 3's!

I know what you mean, What you could also do is request the CRA's place a notice of correction against the A&L entry. This allows you to notify searchers that your aware and its in dispute. someting on the lines of:

"THE AMOUNT ON THE ACCOUNT STARTED xx/xx/xx IS DISPUTED. THE BANK HAS REFUSED TO REFUND £XXXX WHICH IS OWED IN WHAT I BELIEVE ARE ILLEGAL CHARGES. WHILST THEY HAVE EVERY CHANCE TO REPAY AND CORRECT THIS INFORMATION, THEY HAVE CHOSEN NOT TO. THIS IS NOW A LEGAL MATTER AND I THEREFORE ASK THAT IT BE IGNORED FROM YOUR SEARCH. SIGNED XXXXXXXX"

You may as well write "I AM A FISH" 500 times for all the good it will do

1. Thats really helpfull well done keep up the good work

2. I know they actually do check all NOC's before making a decision, it shows future lenders your not ignoring any issues on your credit file, and that the matter is being dealt with.
