Default Default Barclays running credit account

Hi,

Im new to the forum and have seen the various threads for people who have had successfully had defaults removed as they where added incorrectly.

My issue:

I had a barclays account which had an outstanding some of £1400.00. It was one year that I had no statments or paperwork from them. Then I recieved a letter from debt managers who asked for the payment (seems the debt has been sold off). I paid the amount with my credit card but Barclays added a default on my account with no notification. I sent a letter asking why. This is what they said:

This is a running credit account and therefore payments can be requested upon demand.

A terminiantion notice was sent to me to tell me this. (not recieved one and can this be a default notice)

No default notice is required as this is a running credit account.

Is the above correct? Im really confused and feel that I've been had by Barclays. Does the default have to be sent? Is a termination notice a default? How could I back my arguement?

Really appreciate everyones help here...

I read on here somewhere - but can't seem to find it now, that with running credit, a termination notice is all that is needed and this is in the place of a default notcie - in effect the same thing, but different terms for different types of account.

I'm new here so wait for someone to confirm that, but I am pretty sure I am correct on that.

Hopefully someone is able to clarify. In an original correspdent they did say that a default was sent now they deny this as its not required. So they have contradicting information which confused me.

I was hoping that a default notice is a requirement for this account as then I have a case to contest against them

Send them a CCA request and include within it a request to see the default notice that was sent to you and the notice of assignment from the original creditor.

I can send you a letter to use if you PM me.

B11 as far as I am aware they do need to send you a default notice. All a default notice is them telling you that they are terminating the account due to your not meeting your contractual obligations to them. Barclays do usually send them out. I know because they sent me one on my 21st Birthday many moons ago, to terminate my account(s) with them. I've still got it

Funnily enough I am banking with them again (yiikes) and have my Business Bank Account with them too!

I've just recieved word back from the them. They have provided me with a certified copy of the termination notice but no credit agreement.

What should I do now? request they send me the credit agreement?

If they dont have to send a default notice then how would I go about getting this removed as I planning to buy a house in the coming year and very unlikely to get a competitive deal.

No CCA provided?
What regulation can I use to request my CCA because if they are unable to provide this surely they are unable to put a default against my account.
