Default Nick vs Co-Op Bank & Smile

Hi All
Needing some advice please. Am new to the site.
I have been dealing with both co-op & smile bank in trying to reclaim my bank charges. To date however I have not had a result.

So far....

30 March 07 - Letters requesting copies of statements for 6 yrs.
16 April 07 - Letters to chase no response or acknowledgement
4 May 07 - (After having recd statements) Letters sent requesting bank charges refunded.
10 May 07 - Recd acknowledgement letters of a "complaint"
31 May 07 - Letters sent to chase as again no response

6 June 07 - Letter recd from co-op bank saying they need more time to investigate & this can be upto 4 weeks.
7 June 07 - Letter recd from Smile saying similar
11 June 07 - Letter recd from co-op regarding Smile account. This is threatening letter about my outstanding balance on the smile account. This has basically continued in past few months to go more & more overdrawn due to their bank charges. Not by me using it at all!
14 June 07 - Sent secure message to Smile stating my dissatisfaction that i had recd such letter when the charges were due to them etc & that I still had not recd a reply regarding the charges.

Present day - I have not heard anything from either Co-OP or Smile.

What do I do??! Help!

you should have stuck to your schedule regardless of what they have said or done

Hi. Just a bit worried as today I have received letter from smile header "Warning - Formal Demand is Imminent". This is due to my overdraft being over the agreed limit, which is due to overdraft charges taking me over & due to my ongoing dispute about charges, me refusing to bring my account back within the limit.

The letter obviously states the usual threats etc & gives 7 days to contact them with payment proposal otherwise these threats will be actioned.

What do I do?? I have still not had any reply from my dispute & LBA's were sent last week.

play them at their own game.

reply to the letter with 'payment proposals' ie copies of your already sent pre-lim, and LBA, here you go mate, this is my repayment method.
you get your finger out of your ...and you will get your money.
oh and by the way, the more you charge me, the more i shall reclaim.
its your unlawfull charges that put mye in O/D, so its now up to you to fix it.

that should get them thinking!!!

Letter to similar sort sent today with copies of all corres sent so far!
Will let you know how I get on, however reckon by the time they reply it'll be 14 day time on the LBA (4/7/2007).

Hello...well firstly kinda good news in that Co-Op bank have refunded money directly into my account...this however is a lesser amount than claimed. The amount is for the very first request from calculating how much charges etc had been taken. In my other letters to them, further charges were accrued & documented in the letters. They are approx £200 less the amount claimed...what next??

As for Smile, no such success or reply yet. I did however on the same day as co-op refunded, get £50 refunded into the account. Still £700+ short!
Again what next?

either accept the payments as partial, or reject them outright, either way, write them letters, to tell them so.
time almost for moneyclaim or issuing of N1
