Default TonyDi vs Co-op

Hi all,

Have received reply following my Subject Access Request request, noticing that the Co-op have not sent the statements, rather their own tallying of the charges, split into

Commission , Debit Interest, Fees.

Having read some of the other threads, I gather I can claim the fees (£460) and all the commissions over £8- (£195) , although I am still not entirely sure why the £8 are not claimable. Most perplexing is the debit interest column, which ranges from 7p to £28.53 in totals.
Can someone direct me to a thread where I may be able to make sense of what I can claim? Also is there a co-op only interest calculating spreadsheet - as their terminology for charges seems rather unusual.

In addition the accoun, has been overdrawn for approx a year, accruing around £4 a motnh debit interest- I presume these monthly charges will not be claimable.

Any help sending me in the right direction would be massively appreciated.
Cheers.

Hi

I would ask for all Commissions back, whether under £8 or not.

As for interest claimable, you can claim the portion of interest charged to your account, incurred due to the fees. This can be hard to determine.

You may be better just to ask for your charges and Commisions back, and if you get to the Court stage then ask for 8% interest.

Hope this helps.

Dear TonyDi

Depends what you asked for in your Subject Access Request. Ring up Customer Services in Balloon Street, Manchester and say thanks very much for your help in sending info but to help me make sensee of it please could I have all my statements. Remind them of the 40 day limit to comply and for the info to be sent in a robust packet (ie Jiffy Bag) and they'll agree. Offer to pay the £10.00 chareg for this but they should decline this ...

This is what happened to me. I was then able to compare what I saw on my statements with the information on their list and decide what to claim for. I claimed for: Commission, Service Charge, Daily Excess Charge and some Fees. I did not ask for my Privilege Account Fee £8.50 at present) nor did I ask for Debit Interest although some people have. It depends if you want to fight this or not.

Personally, I did not include interest in my spreadsheet of charges but was prepared to go for the 8% at MCOL level.

I won back £4764.57 and it took me just over five weeks. Co-Op are the most compliant of banks at paying up ...

Keep us posted

P

yep i'd go with that. too, see my thread in sucesses
i wrote a letter afterward about the interest they had charged
and got 8% without pushing.
infact they indicated they were obliged to pay it.
see the letter at the end

Tony they did exactly the same thing to me. Couldnt understand the spreadsheet they sent me!

Ive just added the two together and we'll see what happens.

They told me on the phone I was not entitled to fees and they were not considering fees claims which I now know to be untrue.

Hi All,

My claim ended up being for £703.Received the standard 'sorry to hear letter' 7 days ago , promising to contact me within 7 days. As yet I have heard nothing and today is 7th day, aswell as being the 14th day (relating to the sending of the LBA.)

I am unable to access my 'sorry to hear letter' for the next couple of days- does anyone have the phone number that comes with that letter? Just i would prefer to ring direct than go through the standard customer service number.

If not no worries, I shall get on the case when i get back.

Many Thanks.

the £8 fees are not claimable because they are a services charge for your previledge account for which you get services i'e travel insurance etc.

I charged the co-op 9.9% interest which is the banks Authorised rate although the fees and charges they took where in my mind unauthorised but i thought charging them 29.9% they could give me a battle and anyway 9.9% came out at £818.31 which i thought that will do me lol
