I have long been angry about the way these charges are taken immediately from my account - the worst example being the day they refused a £30 direct debit (only had £29 in the account), then took £35 off me! Now I find out they are acting illegally!!

About to start the process of getting my money back. Getting Subject Access Request ready, but who do I make my £10 postal order payable to - The Cooperative Bank PLC or do I need to know the name of their data protection officer?


Your help will be much appreciated.

Make it payable to Co -operative bank PLC. But with my request they returned it saying it was not required.They just sent a printout of all the charges .

Andy.........make sure you send all correspondence to them by recorded delivery, keep all receipts and dont forget to print off proof of delivery signatures from Royal Mail website. They will try to wriggle and the more proof you have the better. I reclaimed charges from Co-Op, got as far as MCOL but they paid out after they issued a defence to the court. I found it all pretty painless really............good luck

Subject Access Request was signed for on 28th Feb. Still nothing back from them yet. 40 days run out on Sunday, so not looking good so far.

Andy, have they cashed your cheque and if so, when?
If they have failed to respond, leave it a few days and then check out the template libray for the 'failed to respond to Subject Access Request' letter, I'm sure its an oversight on their behalf, I suspect that they a whole host of complainants to deal with and is most probably a delaying tactic. Stay strong and focussed.

Did the acknowledge your initial letter?

Hoorah. Got my list of charges from the Co-Op today. Nice covering letter saying:
'...am pleased to enclose the information requested in relation to your account.

As this type of data is provided free of charge, please find enclosed your cheque for £10.00'

So I got my postal order back too.

I have read in a recent thread that someone spoke to the Co-Op and was told all commision can be claimed for as well as the fees (except the account subscription fees).
So I will be asking for £728 back.

Hey good on you, got the same letter as you! Was going to ask about the fees too.....but your thread answered all my questions...Thanks

Just for the record....British gas took money out of my account without authorisation ..dont have a gas account with them and as a result they overdrew my account and all my direct debits bounced and I incurred over £140 in charges. The Co-Op refused to pay it back and sent me a lovely letter ..due to the activities on my account all standing orders and direct debits HAVE been cancelled!!! i cannot make no more withrawals etc. . I called back in a rage and they had the nerve to say after being with them for over 20 years!!! as a gesture of goodwill they will reinstate my mortgage payments only!! I say stuff Co-Op!! CLAIM your charges and change banks

well peeved!!!!

Okay, got the standard 'sorry to hear you're not happy' letter in reply to the prelim. So now they have until Wednesday before the next stage (LBA).
Until Wednesday I'll be checking my account every day. Fingers crossed.

Nothing heard so LBA sent and signed for on 11 May. Got another letter on Mon 21st saying they needed another 40 days to investigate. Now there's only 1 day left before the 14 day LBA time scale, though I may wait until after the bank holiday weekend before taking the next step and starting court proceedings.
I really don't see what there is to investigate - they sent me the list of charges, it's against consumer law, so 'gis it back!
