Smile Re: Carter V Co-Op

Hiya All

Ok got my list of charges today along with a returned CHQ of £10 now is the hard bit working it all out.

I have a priviledge premier account for which i pay what they call on my statements a subsciption there is none of these on the list they sent me and i know i can not claim these as its a service charge for which i get green flag, travel insureance etc.

so i guess i can claim all that is on the list minus the debit interest which is only £70 anyway.

O h and ive notice there is a commission charge of £121.50 what the hell was that for ill be buggered if i can remember back to may 01.

Anyone know if the is a template for getting the statements from the bank as this list is not easy to work out.

My claim will come to £2.887 not including interest and asuming all on that list can be claimed

Regards

Section 7 – Data Protection Act 1998

Dear Diane Sanderson

Account: ********

I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated 03/02/2007. The disclosure of personal data is incomplete in that the following documents are missing; you have failed to provide a complete set of full statements going back 6 years

This is not an exhaustive list by any means, it is just an example of some of the information I am missing.

Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

You have a further 12 days to comply with my S.A.R which I sent to you on the 3rd February 2007

Yours Sincerely,

Perhaps I am being too cautious but the reason we are advised to ask for data is because the banks can charge £5 a sheet for statements. If they choose to send statements all the better for us. I would be inclined to ask for data for whatever periods are missing but again state that statements would be acceptable.

Some of the banks are becoming overloaded with requests. Halifax received almost 1,000 requests in a week recently. Don't you feel sorry for them? Sally

If you do that there is a good chance that you will end up with nothing as they will realise you don't know what to claim. Some months ago I came across a thread called 'historic guide to charges' or somthing like. This may be what dx100uk was referring to.

Perhaps it would be an idea to write back asking about this commission charge and anything else you are not sure of. Get it wrong now and you will end up with nothing IMHO. Alternatively read lots of threads, particularly the longer ones. Mine will be useless as I am claiming for a credit card. Sally

I couldn't cope with the advanced spreadies so I went for the simple version, and I don't think you need to fill in anything from 'i' onwards. Anyone else have an opinion on this or how to obtain statements? Try looking on thread called 'Spreadsheet with interest'. I think it is in general section.

Yes it is and I think you will find information after p1200 useful

Hi PF

Yo udon't need to send off an LBA at this stage, you need to call the Customer Services people and make a polite request for your statements. This is what happened to me and all was well.

As has been mentioned before, it depends what you asked for in your Subject Access Request; a complete list of transactions OR my statements?

I got the list you got from Co-Op as a result of Subject Access Request request, then rang Customer Services in Baloon St Manchester to ask for my statements.

I spoke to Claire Maddick and after thanking her for sending the info asked if I could have all my statements and offered the £10 cheque again. I reminded her of the 40 day limit and asked for the info to be sent in a jiffy bag. The response was positive.

I received my statements a few days later, checked the info in the sheet they originally sent against what was in my statements and claimed for :

Commission (everything listed), Service Charge, Daily Excess Charge and a couple of Fees.

I did not claim for my Privilege Subscription Fee (currently £8.50) I put all this in my schedule of charges and sent it off with my prelim letter.

I began all this on Dec 14 2006 and had £4764.57 put into my account on 30 January listed as a 'Commission Adjustment'

Dont dither my dear, just do it.

Cheers

P
