Default Kicking Kay v Co op - **WON**

hi everyone this is my first post im abit nervous as im not sure im in the right place but im sure some one will direct me if im not!
ok i wrote my first letter after calculating my total charges sent it recorded delivery now i have had a reply
"we will ring you in due course"
now i am not waitng for more delay tatics they have til next week then i start step 2 ......................... .............problem what is step 2 i know i read somewhere claim on line but to whom and where and how lol
any advise would be gratefully received

You the send second letter from the library informing them that if they do not respond within 14 days then you will commence action. Mind I have done this and got a letter back asking if I wiil give them 6 weeks to deal with my claim!

ok update i have today filed an online claim now as im sick of being fobbed off by computor generated letters thanking me for my patience and i can i wait a further 6 weeks!

hello all, well i received my letter from the courts stating they have received my claim and anticipate that the co op should receive theirs first class post, their dead line date is 02/10/2006 by which time they need to reply if not i think that means an automatic win??????
anyway lets see how they play it now, im a bit worried as everyone seams to be settled up before online claim is filed!!!!!!

i have just checked my account online and i have had my chargesd refunded except for my court fee's shall i stop my claim ring them or what or should i just be grateful for getting my charges refunded? i had no written confermation just a refund!!!!!!! im not sure whether i should ask for those too, if not how do i now cancel my MCO?

I would be inclined to remind them that they still owe you the court fees as you would not have had that expense were it not for the charges.

morning all HELP!!!!
ok had charges refunded as you know wrote letter to court yesturday to acknowledge this and close case however this morning i have had a reply from the courts staing the Co-Op are defending the case, does that mean they are taking me to court they have already refunded the money im so confused!

ok as you know i have had my charges refunded however on the friday after i received a ltter from the courts "co op will be defending the claim", im now really confused they refunded me my charges what are they playing at???? im so confused should i be worried i have already written my letter to the courts informing them the claim has been settled but its in my bag waiting on your advise................... ............

It's standard practice that they say they're going to defend.

In fact, it's the only option they have realistically, as the other options are:

1) Admit that the money is owed (you win)

2) Admit that only part of the money is owed (you win)

3) Not reply at all (you win by default)

By acknowledging the claim and stating to the court that they intend to defend is the only defence they really have left.

This means they still have the option to settle with you, out of court and "without admission of liability" - which they have already done in your case so you have absolutely nothing to worry about.
