Hello, can someone give me some advice please. We bought a Philips LCD TV from Comet at the back end of April 06. We paid £999 for the TV (it had been reduced from £1500). Since we first bought it it has had three lines of ghostly sripes which go from the top to the bottom of the screen. When the screen has lighter colours on the lines are not so visible but when the screen is darker they are so obvious and are becoming really distracting. My other half seemed to think that the lines may have been coming through a dodgy satellite signal so he chose to ignore the stripes but we have since discovered that the stripes are nothing to do with our sky system as they are always there when we watch a DVD too. We called Comet where we had bought the TV from and they said that Phillips were responsible and they would send an engineer. The engineer came last week and said that it could be classed as "normal tolerance" whatever that means. He had never seen these sort of stripes before and I am now awaiting another engineer today who supposedly deals with LCD TV's. Why they did not send him in the first place god only knows. This is our first LCD TV so I dont really know the ins and outs and common faults but has anyone else out there had a similar sort of fault with a philips LCD TV and what was the outcome. If the engineer comes today and they have to take the TV away am I entitled to a courtesy set while ours is being repaired? If not can I demand that the TV be repaired on my premises? I really don't know what this engineer is going to say and I am worried that because I am a woman in the house alone he will try to fob me off. I am really cheesed off with it all because if my hubby had taken the set back straight away we would probably been given a change of TV but now I am lumbered with spending another day waiting in for the engineer. I would be really grateful for any advice.

Well, Comet lied to you for starters.

Phillips are NOT responsible, Comet are. They're the ones you bought the TV from, and they're the ones you have a contract with. So don't let them fob you off with that answer.

Yes, your hubby has done you a disfavour here. Furthermore, it seems as if you are outside the 6 months period from purchase where the onus was on the company to prove that the TV wasn't faulty from the start, and it is now up to you that it was.

Regardless of the above (although digest it for future reference), the TV s less than 1 year old and Comet are taking the proverbial by fobbing you on to Philips.

As to whether the repairman wil be able to fix it on site, or whether it is fixable, I can't help you there. Courtesy TV? I doubt it very much, tbh.

Don't forget to tell the engineer the fault has always been present. If the TV was faulty from scratch, it might not be repairable... Either way, you'll have to wait and see what the engineer says before we can advise on your next step.

My once expensive TV died on me, bang. I panicked, started researching consumer acts, etc... Engineer came out, in 5 mns, TV was fixed, literally.
See what engineer says, then come back here and tell us what's been said.

I would not be prepared to accept this.

Take it back to Comet, they can fob you off with engineers visits all they like but in the end, your contract is with Comet and not with Philips.

There should not be any ghostly stripes on the screen, clearly the set is unfit for purpose and you are entitled to a replacement under the Sale of Goods Act 1979 s.14(3)

Hello, all, finally the engineer came and told me that the problem was with the circuit board in the back of the TV here the scarts went in. It was not a problem with the screen. He has been back to Philips and they have told him that this part cannot just be replaced so they have agreed to exchange the TV. They are sending a form for us to complete and take into Comet and they have said that we can pick any other TV up to £999.99 which is what we paid for the original one. The problem is we really like our TV but the equivalent TV in Comet is now £1199.99. The TV itself is identical, the only difference being the colour of the casing. Basically all we want is a replacement of the same TV but I feel begrudged to have to pay more for it. In this situation because the TV cannot be fixed are we entitled under the sale of goods act to ask for a refund then we can shop around and see if we can find the same TV cheaper? I'd be grateful for any advice.

I'd say that it is outrageous that you should have to pay more for the same TV after being inconvenienced!

I suggest you go back to Comet and say that you want a like for like, how much the TV is now is not your problem, all you want is the product for which you pay a large sum of money 7 months ago, and why the hell should you pay £200 more to replace their faulty item?

Tell them that the offer is not acceptable, and that you want the equivalent TV in exchange at no cost to you. They have the same TV, there is absolutely no reason for them to try and charge you extra for it.

Hello Bookworm, thanks for your reply, my husband has just been to Comet and it turns out that the TV is not exactly the same although the difference is "negligible". Ours has a part called "pixel plus" and the one in the shop is "pixel 2 plus" whatever that means. Apparently the TV we bought only in April is now discontinued so god knows what we do now. Whats our position now?

My opinion, straight: You're trying too hard to find a compromise. If it were me, I would say: You sold me a pup. 7 months down the line, I have a 1k TV that is good for the scrapheap, now you're expecting ME to pay another £200 to replace it? I don't think so, this is YOUR responsability, now how are YOU going to solve this to my satisfaction?

Start having a look around to see if the same TV you had can still be bought and at what price, just in case they try to play silly buggers.

Hi Bookworm, can we quote the sale of goods act to them? Can we actually go in and say we want a like for like (or as near as damn it) TV regardless of how much more the like for like TV now is. Sorry to sound thick but I really dont want to go spouting the sale of goods act to them and make myself look silly if we are wrong. Surely its not our fault that the TV is now discontinued so really it is up to them to replace our TV with the nearest model regardless of how much more it costs. The cheeky sods really made us laugh last night, we live in Yorkshire and when we bought the TV the local comet did not have it so we had to go to another store approx 20 miles away which is fair enough. When we went to our local Comet last night he stupid salesperson said and I quote "Why don't you try going back to the Comet where you bought the TV and see what sort of a deal they can give you?" Cheeky sod!! Obviously he was trying to fob this problem off on another branch of Comet. His Manager was listening and was highly embarassed considering the Comet is a chain of shops and surely the deals are going to be the same in each store!!

and take it with you (and in future, carry a copy of it in your handbag, I always do!), and point out all the good bits.

As I previously said, I certainly wouldn't accept to have to fork out £200 extra for a as near as damnit identical TV, and neither should you.
