Have just had a long missive fromone 'Brian Smith' solicitor and I shall be posting my reply for blessings (or otherwise) before despatch. However (there's always one of those!) he does quote a case "Kissick v Citifinancial Europe plc" where he maintains that the 'fairness' of the £12 was put to the test - not found wanting - case dismissed. I am presuming (hate the word) that this might have been at Salford County Court since he (Smith) already promises to 'exercise the defendant's right to have the claim transferred to its home court' ; he then names Salford County Court. Any advice on 'Kissick etc' please or can someone give me a steer on how to find out? Did they REALLY manage to get one 'over the wire' whilst we weren't lookin'??

I got the same letter (similar).

Think that case was one where he had not prepared and lost for that reason only. Someone elsew should know for sure.

Hi - don't worry. Brian is sending that letter to everyone trying to put them off.

He can't have the case transferred to Salford as Citi is a company and the claimant, as an individual will have the case heard at their own home court.

PM Martin3030 if you need any advice on the wording as Citi monitor these threads (and print them out and then try to - unsuccessfully - use parts of them in hearings, as I know to my experience)

Indeed. Citi may well have put that to the test - in a CLOSED hearing without the claimant being privy to the information - either BEFORE, or indeed at the court.

There are things afoot

Also, they have been ordered to disclose in another court since then, so time will tell

Personally, I would continue as before. If they want to play this game, then fair play. We're more determined than their solicitors are paid, if you catch my drift. Enjoy it!

Plus, other things are afoot regarding their access to this forum

(Maybe they should have read the rules )

Received a letter from Brian Smith last week. His letter stated that the OFT ruling does not apply to mortgages and they think their charges are fair and they will not be giving me anything back.

This is on an account they say they cannot trace.

Whether or not they find the account dosen't really bother me as there is a default attached to the account which I want rid of, so either way I will be a winner.

These guys just get funnier, it was the OFT statement which drew everyones attention to the charges issue. Even before that you could have deemed any charge which resulted in a profit as unlawful.

Kennyh, you should also be made aware that Citi will most likely try and persuade you that you are due more or less than the total amounts on your spreadsheet. Its a tactic they have tried with 6+ of us on here.

Hello all you Caggers out there. It is great to be able to post a reply as before I had difficulties ( still dont know why)
I like many unfortunate individuals are experiencing problems with CITI cards. Basically I was late on making a payment twice in 6 months. I have had an account with them since 1999. Working away from home long hours,being single and running my own recently started company very difficult to get to a bank or even telephone a payment working over 70 hours a week and that dont include travelling. My October statement rocked me somewhat as my interest rate charge had gone from a very reasonable 5.8% APR to a mind numbing 31.9% APR. In real terms interest of about £45 to £50 per month had risen to £293. I telephoned the CITI customer service number and spoke to an Indian sounding gentlemen. I set up direct debit but would they return the interest rate. No! When I enquired why I was told it was because I had been a customer since 1999. Interest rate on November statement gone to 32.9%. December 4th sent letter politely requesting Subject Access Request at Salford address. Today I phoned them for the 3rd time to ask if they have recieved my letter. Their answer was no. Waiting for my bank statement to see if £10 cheque cashed. If not will send letter special delivery. Interestingly a friend of mine has recieved via the post CITI's New Terms and conditions effective from 2nd December. I didn't. A few changes there. Basically miss a payment and they will remove any introductory interest rate. Once removed it cannot according to their new t and c's be reinstated. Had a look on their website for their credit card info. Very little there on terms and conditions regarding effects of late payments. Some strange rules there! Enough of me rambling on. Will do what ever it takes to get the result I need. Learned a great deal from this site! so thankyou to all those who have posted. They appear to me to be very devious indeed. Happy New year to you all and dont give up. Thanks again

Best off starting a thread of your own, so others can advise your specific circumstance instead of adding to someone elses.

Its standard (if dirty) practice for companies to write the withdraw of any promotional offers into their T&C, its industry standard, a way for them to hook people in and then squeeze loads of money out of them if they slip up.

Citi havent been answerring correspondence from Salford for some time as they have moved their operation to London.... I think their ammended details should be present in the address section on here. There not will add now, but also below:

Citi Cards,
CitiFinancial Europe plc,
PO Box 49920,
London SE5 7ZF.

If you are having problems, and you have not been informed of the change with relation to late payments affecting promotional offers regarding interest I would suggest corresponding with Citi on one occasion, if that fails get in touch with your local trading standards explaining the situation and see if they can help.
