Default Evidence of Automation?

I just got a load of Data Protection Act stuff from Capital One for my credit card account and it might be quite interesting, which is why I've posted this in general...

They've included (possibly to try and overwhelm) loads of screenshots from one of their computer systems for my account showing processes and things like letterrs generated, decisions etc...However, and I haven't properly studied it yet, interesting words do come up, like 'auto' and 'system' as opposed to an actual person's name (which do come up as well)...Has anyone else been sent this kind of stuff?

Yup, had it from A&L. This is to show manual intervention or otherwise.

I too have recieved mine with the copies of screen shots and the codes. If you look closely is there any instance that an operator has pressed the button that generates the charge and the letter. If there was then there would be legions of operators monitoring accounts to send these out. The info they have sent is correct but me thinks they are hoping to bamboozle and confuse.CitiCard admited to me that charges are applied automatically at midnight on the day of the alleged offence, why would capital one be any different.
Good luck with your claim.

cheers

update: After issuing my claim online Capital One has offered me the full amount, accepting no liability...Which is cool, but I stupidly didn't request in the claim that they remove my default, so I'm not sure how to proceed...I think I shall sign their little form but include 'I will no longer seek for the refund of unlawful penalty charges, but I am obliged to continue to seek the removal of my default notice if you have not already removed it' or something...

That is a bit dodgy but Nationwide seem to keep saying they intend to defend but pay up wihin a couple of weeks so am sure Cap 1 will pay up.

How long did it take between MCOL and offer of setlement?

I think that by entering a Defence it is their little way of saying that they do not admit the claim, yet they pay it anyway.

It's just general playground crap, tit for tat if you will.

I know most banks state that they INTEND to defend, but apparently Cap One has actually ENTERED a defence!

It will be interesting reading, anyway
