Wink Capital One Good will letter

Recieved today goodwill letter for £295 instead of the £795 i was asking for which includes interest etc. Currently owe 1,000 which I am paying off through NCO ( have sent prove it letter to them which iam sure they cant) If they paid me the amount that I am asking that would greatly reduce what I owe which I can then pay off. Which is the best way forward accept part payment and go for the rest. Or refuse and go that way, have found the templates, would just like to know with other peoples experiences on this site with Cap one.

Hello Pecky

There are some rejection letters in the Bank Templates Library you could amend and send. If you accept their offer as a partial payment to your claim, you make sure they are aware of your intentions to recover the rest, with the court's help if neccessary. Sent letter to cap one accepting part payment but will chase the rest etc waiting for reply, Sent request to NCO for CCA who are dealing with the debt, recieved today a letter from them, It says see attached a copy of the application made to cap one and associated credit agreement i should contact cap one for the deed of assignment.
They have sent me the origianal application form photo copy and i have signed the bottom of the credit card account agreement. Please help I thought the credit agreement would have had the apr and conditions on it so have they sent the right agreement and does that mean they own the debt so i have to start paying NCO again or are they bluffing me, And what is the deed of assignment? Do i need that if i take legal action if cap one dont reply to my letter. Im sure someone out there can enlighten me

APR is a prescribed term They don't have it on my MBNA agreement so improperly executed and unenforceable is my opinion there will be others with more knowledge also have a look at consumer agreements thread

Just recieved reply from Cap One after rejecting thier original offer, they have now told me they have made a mistake, and are now offering me £325 instead of the £295 they original offered, This is thier final offer so they are already omitting they have made a mistake, so now i will reject that offer to them and them put in a court claim, I have not CCA Cap one do you think i should do that or leave it, as NCO were collecting the debt CCA them and they sent me back an application form and surprise this morning recieved letter giving me 48hrs to pay so they will get a nice letter back about not complying with my CCA request which is now way over thier time limit. and the account is in dispute.
The money that Cap one owe me is £795 which then would nearly clear my debt with them. Cap one have picked up that i have not made a payment this month as obviously i am not paying NCO any more, Would it be wise to send them a token payment? when i reject thier offer before i start the court claim?

Hi I have contiuned making agreed payment as keeps them from appying interest again. Conyinue with claim anything you pay would be calculated in amout you would receive after card cleared.
