Default Urgent Advice Needed

Got a letter on may 25th saying they are settling whole amount and would I inform court of this - I sent back a letter saying yes when I receive the cheque I will do this- today for some unknown reason I look at my mcol claims and i see this: ( wasnt there yesterday)
Defence
You are unable to take any further action online on this claim.

The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly.

Have they made a mistake? I have the letter saying I will receive the cheque for the full amount within 14 days from last weeke? any ideas? surely they cant change their mind?

Have you rang Cabot ?

Suggest a quick call to them asking them if cheque issued & when can it be expected ? Refer to the letter you received sating that they have agreed in full to the claim. Don't refer to the online statement yet, speak to them as if you haven't checked.

Meagan

That is normally what they do so don't panic. There is a pattern to their madness. The increased costs in them playing these games must be enormous. You should have your refund into your account or a cheque shortly, in full. Check online everyday from now on. The funds are normally paid in before the letter you will receive. Chin up, your very close.

update - cant get through on phone to mcol - they say their website is down aswell and have their IT guys on it. Letter from court in post this morning aswell - N236 - notice of defence that amount has been paid. Court is asking me if I want to continue - yes or no because they say capital one told them they have refunded me the full amount I asked for - but technically thats not right - they havent give me anything yet. I rang capital one and they woman(couldnt understand her accent properly) kept repeating 'the cheque was sent out ot you on 24th may' I told her theres no way it could take that long - shes said'cheque was sent in post on 24th and you will receive it within 14 working days' I kept trying to tell her thatt no way could it take that long - she just kept repeating herself - obviously had a script in front of her to read out and could amswer no questions. - no other phone number from her either she said there isnt one. I noticed fax number on court papers I had where the legal representative had signed it and put on it the telephone number and fax number of her office so I have faxed over a letter asking her what the hell is going on! I'm at a loss as top know what to do now.I think i'll also do a wasted costs order and claim for the stress theyre putting me under with all the confusion!
