| Atlantic vs. Capital One Hi all......
I'm just starting this thread as have read all yours and will be sending out my Subject Access Request within coming days.......
From as far back as I remember CapOne have been slapping on monthly charges in addition to all that interest....... so it'll be good to at leats start to turn the tables...... |

Please supply me with a complete set of statements relating to my banking history with your organization (Capital One).
Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you.
If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response.
I enclose the statutory maximum fee of £10. You have 40 days in which to comply. Furthermore, if I discover that you have levied disproportionate penalties against me, then I shall be reclaiming them, and also reclaiming the enclosed £10 Data Protection Act subject access request fee.
If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one which you normally use to communicate my private business to me and which you have hitherto found to be acceptable.

I've got all my statements back, and sure enough as all your threads seemed to be saying, there wasn't really any problems in getting these....but...
I know I have to add all the different types of charges onto the spreadsheet - but can I add the "Cash Advance Fee" as well? I have loads of these, and most of the time they are for £2 or £3 a time - but they really do add up to quite a bit!
Please please could you advise if I am allowed to add "Cash Advance Fee"........  |

i really do want to hit them for compound interest, as well as the 8% (s.69 CC) - can you recommend a good spreadsheet 4 this? I've been using the ones at front of CAG website - but just want to see if you or anyone else has anything better (liek Vampiress Chambers for e.g.)...... |

I have now completed the spreadsheet and first LBA for Capital One..... so here goes it: What I require I calculate that you have taken £530.04 plus £198.28 which you have charged me in overdraft interest for the sum which you have taken. This makes a total of £728.32. I request that you refund this amount in full and enclose a schedule of the charges which I am claiming with this letter. Targets to resolve this matter I hope that you will enter into a sincere dialogue with me about this matter and write on the assumption that you will prefer to do this rather than merely respond with standard letters and leaflets. You have 10 working days, from receipt of this letter (i.e. by Friday 29th June 2997), to reply unconditionally accepting my request in principle and letting me know a date by which I will receive payment. If you do not respond, or do not respond positively, within this time period, I shall send you a further letter before action allowing a further 10 working days in which to reflect. I believe that these targets are more than sufficient for a large company such as yours with dedicated staff and departments. After that will be no further communication from myself and I shall issue a claim at the expiry of the second deadline. I look forward to hearing from you by return. yours faithfully Atlantic

Please edit out the template letters you have posted. These are for use by registered members only. Guests to the site can view posts and reproduce the letters. They don't have access to the template library. As this site depends on donations to survive we don't reproduce the letters in the open forums and allow others to leech off us.

Trucker - I will pm a modertaor about the editing out of letters. You are right about the library, but as far as I can see registration is free, and I have already made my donation(s) from previous claims. I do understand what you mean - but the openess of this site is the best feature of CAG so all us consumers can help one another and equally gain from each others mutual experience dealing with same financial institutions and people. I've also done my best to add to things - given my 8 years of having worked for financial institutions here in london....
I have duly edited out the bulk of the first LBA as my battle is focussed with the credit cards......... |

i've just double checked a few of the other threads - and there's loads of letters and correspondence in open forums, with all the banks, credit cards and other institutions.
i can see the point you are making about templates in open forums, but perhaps you should pm a moderator yourself as from what I see it is quite widespread, although in fairness not widespread on this Other Institutions/Capital One forum. As said above I have edited out the bulk of the first LBA - as my focus is with the credit card companies and capital one..... |

| Re: Atlantic vs. Capital One hmmm...... i've thought a little more about this and it's a little tricky: quite a bit of the reasoning behind posting up letters, N1's and defense statements is precisely so that we can gain from the sheer depth and diversity of opinions and knowledge of people on this board....... thats why i say the openess is key - as I, for one, really gained from other people expressing ideas about some really tricky bits in letters and correspondence from banks - and the only way for people to give advice is for them to see exactly what you're on about in detail........
donating to this site obviously is vital....and that goes without saying..... but i think posting detailed stuff in your own threads in the forums is for individuals discretion on the basis of needs of help and advice.....
I can see your point though: there are a few threads, like yours and many of the ones here on Capital One, that don't post any detailed correspondence. I think it's more down to thread owners individual discretion for the amount of advice they need...... but we can always check with a moderator of just a quick scout round the other threads to get a better idea.....
needless to say - good luck with both of your claims.... I do hope you win as thats why we're all on here  |
