| Re: Beetlejuice vs CapOne rec'd this letter yesterday... Dear Mr Beetlejuice
Account No. 1111 1111 1111 1111
Thank you for taking the time to write to us about the fees we've added to your account. 1 understand you think these fees are unlawful and I'm sorry you feel we've treated you unfairly. Too right I think they're unlawful.
To explain, we automatically add late payment fees if your payment Is
missed, arrives late or isn't enough to cover your minimum payment. We'll add over limit fees if your balance goes over your agreed credit limit, which is £1400. Yes but it doesn't represent your costs incurred.
When we opened your account in April 2002, we sent you a credit card agreement which stated these fees. By signing and returning this to us, you agreed to the terms and conditions for the account, including the fees. yes I know, Iv'e asked for a copy but you have not sent it yet!!
As you're probably aware the Office of Fair Trading, OFT, haven't challenged the right of banks to charge default fees, but merely the level of those fees. Although we feel £20 is a just fee, we've reduced our fees to £12 so that we're in line with our competitors. I appreciate that you've incurred previous fees at the higher rate, and would like to address this. We can and will address this in court.
I've reviewed your account and, as a matter of goodwill, I'd like to reduce the fees we've added to your account to £12 each. This amount is £311. I would also like to offer a refund of an additional amount, £30 as an acknowledgment of any interest you may have incurred. This amount totals £341. If you would like to accept this please sign and send back the settlement form 1 have enclosed in this letter, once 1 receive this back I'll add these refunds onto your account. Think again!!
To avoid more fees, you need to make sure we receive your monthly payments on time. On your statement, you'll find your payment due date and a date we recommend you make your payments by. Also, you need to make sure your balance doesn't go over your credit limit. Well if you hadn't added the fees it would have gone over limit.
While you're disputing these fees, it is important that you maintain payments as your account balance consists of transactions that you have made. No mostly fees now actually and interest you have charged me on them!. Failure to do this may result in negative information being recorded on your credit file, which may affect your ability to gain credit in the future.
I hope I've explained things clearly, but if you do have any other questions, please write to me again. You'll find my address in the leaflet I've included, which also explains our complaints procedure. If 1 don't hear From you within four weeks I'll consider this matter closed. Well I'm not happy and will obviously persue this matter further, see LBA winging it's way to you.
Please accept my apologies for the inconvenience this has caused and I'm sure we'll be able to put this experience behind us. If you 've done nothing wrong, and it's all my fault, why are you apologising
(Please note, calls to the 0845 number at the top of this letter will be charged at a local rate. The cost will vary depending on your service provider. Calls may be recorded/monitored for training purposes)
Yours sincerely
Ellie Renshaw
Executive Office Manager

| Re: Beetlejuice vs CapOne Just re read the letter Cap One sent me.
Surely, they should be charging fees that re recouping their costs not....
"we've reduced our fees to £12 so that we're inline with our competitors"!!!!
So it is a penalty charge then, think I might use this letter in court
!!!
