| Trucker V Cap 1 Hi All
Just preparing my Subject Access Request today to send off to Cap1. I have been having a good read of the other threads and think i may well go for contractual interest on this one. I have come across 1 problem already though. I have tried to download the England - Advanced - Works interest spreadsheet but get a page not found error. I tried to PM imported but his mailbox is full and not accepting any new messages. Anyone got any ideas?

I don't think you can send recorded to a PO BOX | Most times they just give 1 signature for PO box and CRAP1 would be able to say not delivered but I use registerd post (4.10 option) to full address as above then signature required, and I have never had lost letter.

I finally got round to sending Subject Access Request on 5th May. I must say that i was quite impressed with Cap 1's quick response and the fact they sent statements special delivery.
Any way i have gone through the statements and highlighted all the charges and am now at the stage of entering details onto spreadsheet. I am using Vampiress's spreadsheet 16 Throughout claim with compounded contractual interest. I got about a third of the way through and it dawned on me that i should also be entering interest applied to account in months where the was no fee charged!! Am i correct in thinking that as i never clear the balnce interest on penalties is still being charged, therefore i should let the spread sheet work out the propotion of interest chargedto previously applied fees. Does this make sense?? Any help most welcome!!

Trucker | Hi I believe that the spreadsheet calculates the interest paid on the accumulated charges that have not been paid IE the charges are the last thing paid out of any payment you make. I used this and the spreadsheet calculated that for charges of approx £630 I had also paid interest of £390 so yes you should include months when no charges were made against account. Best of luck

I have now prepared the schedule of charges to be sent with my preliminary letter to Cap 1. One question though. I am seeking contractual interest from them, do i ask for the interest as well at this point? I have a claim against Barclays but am only claiming 8% statutory on that and know that you don't add or ask for the interest until you file at court.

"Therefore I require that you repay £348.00 in charges plus £237.77 in compound contractual interest charged at 27.9% (the amount you charge me on purchases.) Total £585.77. I have attached a schedule of the charges to this letter |

My current purchase interest rate from Crap1 is 34.9%. I have worked out that the average over the period i am claiming for is 30.46%. Shouls i be using the current rate to apply CCI or the average rate?

| Re: Trucker V Cap 1 Hi, there seems to be differing advice on rates. The easiest one to argue is an average rate but some reccomend purchase rate as that's the rate they apply to charges. Others claim unautherised rate and win. It's a decision only you can make really. |

Been spending my time in the barclays forum so not really up to speed yet with crap1 policies.
I have just checked my account and have recieved a refund of £124. Not got a letter from them yet. I will be accepting that amount as part settlement only as my claim is for just over 1k. What i want to know is when i send them the rejection letter will they take back the refund or just leave it lying? |

| Re: Trucker V Cap 1 Not sure either way but would have thought if you "accept" as part payment they'll leave it. They'll be paying the rest soon enough. Just make sure you ammend your schedule of charges and that you claim the right amount on your N1. |
