Default Help with Prelim

Hi all,

I have used the spreadsheet template and added all the charges owed.
They total 564.00

For credits cards, do i ask for the 8% interest now in my letter, and send them the Interest on Penalties spreadsheet too.

Also, when do i ask for my £10 Subject Access Request fee back.

I am not asking for contractual interest , as seems too complicated.

Hi

If you wanted to add contractual interest, then the spreadsheet will work it out for you. You need to ask Capital One what the rate is on your card. It can make a big difference to your claim total. If you do want just the 8%, you add that at the court stage through the N1 form or MCOL. Some people have added the 8% interest from the start of their claim, and some banks have paid it.

You can't get the £10 fee back. They are entitled to charge that for the service of supplying your data.

Hi ,

Recived a reply to my prelim sent.
They are redusing the fees to £12 and and say they have refunded the account with £168.00. This still mean we are over the limit.

The charges claimes are £564.00.

Next step.
Do i send the LBA and a letter accepting their offer as partial payment?

the letter adoes not says full and final settlement, but says that if they don't hear from me within 40 days then they will consider the matter closed.

Just an update.

I sent my rejection letter on saturday, and advised them i will accept there offer as a partial payment.

LBA to go off on Thursday.

Do we calculate 14 days, or 14 working days??
