Default capital one Data Protection Act blank!!!!

on the 25th april i sent them a Data Protection Act request recorded delivery,i received a reply yesterday saying "thank you for your payment you recently sent to us blah blah blah"then they tell me about ways i can pay ,at no point in the letter do they even mention Data Protection Act or accept the request
do i still give them 40 days until i report them????

Write back, spelling out VERY clearly what the money was for (I assume you used the template from here, yes?), and that they have x days left to comply. Cheeky beggars. They have cashed the cheque, that's proof enough, the clock is ticking.
