S.A.R - (Subject Access Request) sent 20-1-07, statements arrived today, first one to arrive from anyone! Strange thing is I requested a copy of my CCA at the same time, in the same envelope, No CCA arrived does this now mean they are in default? How do I work out the APR when I don't have a copy of my CCA? I don't know which rate to apply, it's a Platinum card, any one know? Capital one website says 15.90% standard and 21.94% for cash purchases, which one will I use? Itching to get started, I've got £316 in charges on this one card! Yikes!!!! Any advice anyone?!!!! Thanks in advance!

Anyone??? What will I do about the CCA???? I need to make a monthly payment, do I make the payment? Also which is the best spreadsheet to use to claim contractual interest on a credit card? Help!!!!!

I have calculated £316 in charges, sent Prelim letter 26-2-07, still no sign of CCA though. They rang me to ask for payment, so I asked where my CCA was, what do you want it for? That's my business, just send it, still no sign

I called them and asked, they were actually quite helpful, my rate was 21.9% applicable to charges, the same as the purchase rate.

Thanks for that sergeant, I had a call from C**p one today, nervous foreign gentleman, offered me £112 back for my charges. They have received my letter and that is what is on offer. I sais thanks, but no thanks, my charges are £316 plus interest, he said I know that but you are the one who went over your cc limit, no I didn't! My charges are all for late payments!!! What a load of c**p!! They don't even look at your account do they?? Well I'm rather full of myself after my triumph over Lloyds TSB re my PPI payments (getting it all back!!) So I said no I want the full amount, chap went off to talk to someone, came back and then said goodbye!!!! Strange........
Watch this space!!!!
ps still no sign of copy CCA????
