Default chrissy - v - capital one

Hi All,
Right so here we go - just received all my statements for 2 x capital one accounts. How do I now work out what is owed to me? Any help would be appreciated.
Thanks, Chrissy

Chrissy,

You need to total up all the charges and interest charges.

read through the FAQs and numerous threads. Make sure you understand the process and options available to you.

It will make sense what you have the knowledge.

Good luck

Have done a quick calculation and so far on 1 cap one account will be claiming £592 + int and on the other cap one account will be claiming £1484 + interest. I feel a good holiday coming up!!!

Chrissy,

Sounds like you have a nice set of claims. read up on statutory interest (the 8% rate which only applies once you have lodged a claim) and "contractual interest, which you can claim at the outset - ie they have unlawfully taken money from your account therefore you can claim interest on the money at the equivalent to their unauthorised borrowing rate.

There are plenty of FAQs and threads on these issues, choose the one you are comfortable with and go for it ...............

Good luck ........

Thanks Tanzarelli and ukaviator,
Wanted to get letters off as soon as, so this morning have sent to
Legal Compliance Specialist
Capital One Bank (Europe) plc
Trent House
Station Street
Nottingham NG2 3HX.
This is for both Cap 1 cards that I have - it seems ridiculous but only last month they charged me a late payment fee on the same day as the payment went in! Oh well, at least there is some light at the end of the tunnel. I must say that they are the first of my six applications to have returned the info required and they haven't cashed the £10 cheques as yet.

Hi Folks,
Received letter yesterday from C(r)ap One stating -

Thank you for writing to us about the charges on your account.

It's going to take us a little while to look into your situation and come back with a detailed response. We'll do everything we can to get an answer to you within four weeks of this letter.
If for some reason our investigations take longer than four weeks, we'll contact you to tell you why this is.
Thank you very much for being patient while we collect the information we need.
Yours sincerely

Robert Udy
Executive Office Manager

Can anyone advise next step please?
Regards, Chrissy

Hi Folks,
Just a quick update. Have today received a partial offer from C(r)ap One for around one third of what I am asking. The offer letter reads the same as Tanz's #3 with a Complaint Settlement Form attached for me to agree and sign.
Tanz would it be okay for me to use your letter as on your #4 link and adapt for myself?
