Default Capital One Fight Back

Having joined the site last year and read the FAQ's I sent a Data Protection Act request to Capital One with payment. At the same time I sent a S.7 Consumer Credit request to their DCA (Intrum Justitia) asking for signed copy of the original credit agreement and sent the £1 postal order. I sent reminders to both parties but never received even an acknowledgement. Reading the advice of one of the moderators I left things in obeyance for another day.

All letters were sent recorded delivery and the £10 cheque was cashed.

I have today received a summons for the debt from solicitors acting for TBI Financial Services.

Any advice on how to proceed would be welcome.

Have you officially notified them that th account is in dispute?

I wrote to them on 4th July last year advising that I had not received a reply to my Data Protection Act request. In the letter I advised them that I believed the account contained a large number of disproportionate penalties and requested that the account be placed on hold for 28 days after my receipt of statements etc. I received a reply asking me to confirm account details as they had no record. I replied on 31st July advising that the account number supplied was correct, but to date have had nothing further until the summons.
