Default Can I do a Chargeback?

HI! this is my first post and I'm hoping that you could help me. I used Capital One to pay a payment processor (like Paypal) to transfer money to an advertising site online but the merchant never received the money because the payment processor (Stormpay.com) has frozen all my money and my husband's. Now, I made a dispute through Capital One and they're response was this is between me and Stormpay and out of their hands.

My question is, is this right. I thought because I never receive the service I paid for, I should get a chargeback or refund for that Could you please give me more lights on this.

The first thing that needs to be established is why stormpay has frozen your account.

Certainly Capital One would be able to do a chargeback if there was a problem with getting what you had paid for from the supplier. However, this is a different issue as your money has not reached them.

Have stormpay given you a reason for their action?

I know even if paypal freeze your account you can refund payments, as long as it does not push your acc into a negative balance. I've never used stormpay, but is it possible you can refund your own payment?

Either way, cap one are fobbing you off. Call them and demand a chargeback.

First of all, Stormpay.com is an illegal money transmitter that an online advertising did not know because, they have been using it for sometime. Then just in January Stormpay started messing about with this company called 12dp which I deal with my online advertsing. I paid 12dp around £800 through Stormpay but never delivered the money to 12dp. STormpay sent a mass email to all the people who used their service saying 12dp was a ponzi and that they dont want to deal with ponzi company. But ponzi or not, they should give us a refund of our money if they dont want to deal with 12dp...Am I right in saying this?

It was not just me who was affected there are so many people around the world that were affected. They froze our accounts and we could no longer access to our accounts. They ran away with our money. I could not chase 12dp because they never got my money.

So when i reported this to capital one, they said they contacted Stormpay but stormpay only sent a mass email that all of the registered member had. People from Egg company, HSBC and other banks had started getting their moneyback and I dont understand why Capital One would not do it.

I told them in my letter the reasons why I have a point of getting my money back.
1. Paid for service never acquired.
2. It was an illegal money transmitter and therefore it is Fraud.
3. Under Office of FAir Trading sec. 75, shoppers can claim against the card issuer if a purchase is unsatisfactory or seller refuses to compensate them.

Pls let me know if Im right in saying this.
