Default Partial refunds

I feel like I'm writing a lot of posts at the moment but I'm just at that point of making sure everything's right before starting!

When they reply after prelim (if they do) offering partial refund, is it because they've just added it to your account anyway? Or if they wait for you to reply, how long does it take them to add the partial cash? Do they even bother to partial refund at all if you accept in part but still take them to court?

There is an important reason behind this long-winded question: My claim is a bit of a beast and just creeps over 5k with contractual interest. If they gave me a quick partial refund, it would bring my court claim below the big 5 and save a lot of court costs (I know I get them back but the outlay is big for over 5k).

Please let me know what happened to you?

Sorry guys, to put it more simply:

When 'Mr Udy' offers to refund all charges down to £12 after prelim (as he has been doing), is this partial offer just added automatically to your account around the time you receive the letter? Or do they wait for your decision?

Hi Rougesept

You should accept anything they offer as partial payment only to your claim. Mr Udy and his team have probably sent you a form to fill in which the acceptance of that offer. Do not sign it and send your amended version of this:

A couple of posts down is the letter. You will get it all back, but will probably have to file with the court first. Then they will pay up in full.

I asked a similar question a couple of days ago, and the consensus seemed to be that when you partially accept the offer you don't get anything until you go through the whole process. It seems they would only give you it if you accepted that it would be the end of the claim.

Thanks UK, I'm not there yet (only just sent the prelim) and of course will be only accepting anything as part settlement only. I was just hoping that a partial refund would knock the overall figure down before MCOL as it would reduce my court fee.

I was sure I'd seen people who had the partial offer refunded into their account without them asking but now can't find any?! Anyone?

They sometimes do that as a good will gesture and hope you go away. It's the difference of £8 , from £20 (old charge) to the new one at £12. If you carry on you will get it all back.
