Default Advice needed - Capital One A/c with debt collection agency

Hi,

Just after some advice... many years ago I had a capital one card with a £200 limit, I missed several payments partly due to them not sending me the statements like there supposed to do. I must have paid capital one themselves around £300 and have also paid Heatons solicitors another £530 and still owe £426.

What I would like to know am I still able to claim back my charges even though the account is with debt management and in litigation and which would be the best way of going about it. I have asked capital one to supply me with all my statements and when i receive these should I then send them the stage one letter.

Note: These charges were all related capital one and not the solicitors. Over the years I've been trying to pay this balance back I paid money to some other solicitors I don't even know who anymore but capital one changed the debt collectors on a number of occasions without notifying me.

Go for it! I am currently in litigation with them.

My account is with debt collectors and they have CCJ's for the cash. It doesnt matter!

If the charges are from the last 6 years then just follow the procedure as outlined in the FAQ's.

You also need to read some of the posts regarding Debt Collection Agencies.

huh i cant remember how long ago i had my cap 1 acc?
can i send prelim letter and just ask for the last 6 yrs charges nyways ? loli had a ccj against me from them posted re. ccj`s wondering if i can counter claim even tho its 2 months after the judgment ?
