Hi all,

New to the Capital One forum but bit of an old hand at Barclays so hopefully won't pester you lot too much and who knows, may even be able to help!!!

Been reading Tanzarelli's thread and got a bit of a query (yep, already!!)

Where do we stand if Cap 1 offer to refund the charges to £12? Are we
still entitled to claim the lot back as they were unlawful when applied?

What's contractual interest??

Hi Jackie

You can ask for your charges back in full, as the banks will not tell anyone how much the real cost is to them, when you go over your limit etc.
The contractual interest is how much they charge you per month. On your statement it will be say:

1.899% at the bottom of your transactions and balance page.
Times this by 12 and you get the APR.

That figure is what they charge you compounded on your charges per annum. If you have old charges it is well worth claiming.

Have not been too quick off the mark with this one but was heavily pregnant when I last posted so that's my excuse!

Sent a new Subject Access Request off on 27 April and got a reply from a Ms Dubbeld on 16 May which only contained statements relating to one account and only up to August 2005.
I wrote back to her on 27 May asking for the rest of the info and reminding her that the 40 days were ticking and have heard nothing back.
Sent final letter today giving her a final 7 days before going to the Information Commissioner.
Is this just delaying tactics by Cap 1 and has anyone else had the same problem?
